Hi all, I plan to file for N400 next month (September) but I just read about the requirements this morning and I checked that my tax returns for 2015 and 2017 were filed as head of household. I’ve informed my tax preparer to amend the two returns while I will pay whatever penalty/charge back that comes from it immediately.

my questions are:

1. would this pose as a red flag to my N400 Application or at the interview?

2. At what point would I need to submit/show the tax returns; is it during the interview or I have to submit it with the application?

3. If #2 is during the interview, can I use the most recent 3 years tax or it has to be the first 3 years of being a GC holder?

Note: My i-751 is still pending as well ... Pls advise ... and those with similar experience should explain how it works for them ... thanks

What do you mean by "Head Of Household"? What requirement are you talking about?

I mean my status on tax returns was filed as “head of household” and not jointly filed with my wife.

We have a child in this marriage and expecting one soon too.

do you guys think the tax return would be an issue?

Not sure but i think you can file "Married Filling Seperately" It does not have to be joint. I might be wrong though.

Did you actually file "Single" or you did "Married Filling Seperately"

Hello guys I went to uscis office today to get passport stamp . Lady was nice she told me I can apply for n400 but it will delay the case lil bit 😑 now don’t know what to do 😕

I would go ahead and file. That Immigration Services Officer probably said that because it is more work for them. The I-751 and N-400 do not run on the same system. They have to request your I-751. Given that they are not on the same system, it is very likely that the N-400 does not alert them you I-751 is still pending.

They have to think of requesting the file. It's a manual process. They also do not want to deal with the mountain of evidence that most people include for the I-751. Most I-751s are pre-adjudicated before they're sent to the field office for interview. However, the N-400 has a much faster turn around time. Therefore, by the time they have to request your I-751, that file has not really been touched by anyone. So they have to do it.

Just my 2 cents.

It’s been more than 94 days since they transferred my case to NBC Missouri, because I filled for N400 while I 751 still pending, should I get an appointment with my local office and see what’s going on?

Hello fellow Houstonian :) I'm a September 17 filer, and just like you, I am considering filing for the N-400 next month. The Houston office was flooded after Harvey, and now it has been flooded with applications lol. I guess I will file for it anyway, wouldnt hurt.

You should totally do it. First off, it won't hurt. Second, if and when you get approved, you will have both done or your wait time for Naturalization will have dropped.

I applied for both as soon as I was eligible and now I am a citizen. It took 20 months total.

It is not worth it. They will hardly tell you anything useful. You can go but they will just tell you what the system says.

Once a transfer happen, they will say you have 6 months from the transfer date before you can consider it outside of the normal processing time.

It shouldn't flag your file. Everyone makes mistakes. However you should submit the amended ones and may be explain in an attached letter.

Submit them with your application and keep a copy in case you are asked for them at the interview. Typically, they will ask you for the most recent proofs from the time you applied to the time of the interview.

I would attach the most recent three but if you really ask me I would attach all from the day you got married.

Hello @aprilsong72823 , this is great news ! I take it you are a Chicago land resident, usually the Chicago office has been reluctant to interview combo filers but it's great that they were able to do both for you. Did you file for your N-400 online or was it paper based ?

The reason they did it is because I live like 3 hours away from Chicago. I was told that I will only get paper notice, not online. I still haven't received any letters yet. I filed N-400 online.

[08/05/16] NOA (never received, lost in the mail)

[09/15/16] NOA replacement

[10/07/16] Biometrics (early walk-in on 09/27/16)

[05/07/18] Case transferred to NBC

[06/25/18] Interview was scheduled

[07/30/18] Combo I-751/N-400 interview

[07/30/18] APPROVED AT COMBO I-751/N-400 INTERVIEW

N-400 (Naturalization) with pending I-751 (Removal of Conditions)

[07/31/17] Package sent to USCIS (NBC)

[08/07/17] NOA

[08/31/17] Biometrics

[12/20/17] In line for interview

[06/25/18] Interview was scheduled

[07/30/18] Combo I-751/N-400 interview

[08/31/18] NOID received

[09/07/18] NOID response sent back to USCIS
