You need to do contact them ASAP. It's been way to much time. You have the right to do it, based on their own policies. Call again, usually inquiries are filtered: one person -who is not an immigration officer- would try to help you. If he/she deemed that your case needs an officer, then they will call you. At least that happened to me, the same afternoon an immigration officer called me to my cellphone. He was very nice. Keep pushing, you don't want your file to be forgotten or lost in somebody's desk.

I submitted my N-400 in July 2017 soon after I became eligible. I don't believe the info above that the wait time for combo I-751/N-400 is 2 years and 9 months. There have been plenty of cases on visajourney where others have gotten approved with double interviews in much shorter times. I submitted my first ever service request last month to inquire why my case has been forgotten about. I received an automated email telling me to expect a response by July 18....that date has obviously now passed and still no response.

 

I think my problem is that I've been too passive. I waited patiently for over 2 years thinking that USCIS would process the cases in the order they were received but this is obviously not the case. It appears the only way to get things done is to hound USCIS with calls and emails everyday. I called the USCIS phone number (1-800-375-5283, correct?) but only got the robot options. I guess I need to call Mon-Fri to speak to a human? I've also read that I need to speak to a tier 2 officer to speak to someone who can access my case file? Any tips on how to get to tier 2? I am so sorry about your situation. It is horrendous. Unfortunately, every case is different and I really do think this has something to do with Trump. In my experience, calling tier 2 officers is absolutely a waste of time. Some tell you what you want to hear, some will just tell you "It is still pending, that's all I can tell you". In order to reach a tier 2, you need to talk to a regular customer support agent and explain to them that you want to talk to a tier 2, and you will usually be scheduled a call back by the automated system. It will tell you approximately when you will get your call back, but like I said, most of those so called "tier 2" officers will never tell you exactly what's going on. The processing time for 751 in field offices are 17 months to almost 3 years, it is not a given, and it also can't be trusted. The NBC recently had a report saying that the pending 400 cases under Trump have increased by 87 percent compared to Obama's first 2 years. It is obvious that he is trying to slow down the immigration and potentially stop the legal immigration by just dragging it out. What can you do? My lawyer told me you can request a mandamus action by petitioning to a federal judge due to USCIS's unreasonable delays but it will be expensive and you might have to hire a lawyer, if granted by a federal judge, the judge will then force the USCIS to adjudicate your cases if the judge agrees that there have been unreasonable delays on your cases. It is crazy and unthinkable that you have been waiting for over 2 years and nothing is happening. You have done nothing wrong, but you are a victim of the USCIS that is already incompetent, plus the Trump White House definitely is making immigration process difficult due to its anti immigration stance. Not to mention the new memorandum that is going to take effect on 9/11/2018 where the White House is directing USCIS to give applicants just one chance if there's no sufficient evidence, no more RFEs and adjudicators could just deny one applicant and put him or or in deportation proceedings, and it applies to ALL applications. At this point, maybe you need to contact your congressman, and just wait and use the limited resources USCIS provided and hope you will hear from them soon. Fingers crossed.

Still, is good to call. They might know what's happening with his file, but they're also human beings, meaning they could have forgotten his application completely and a call can push them to look for his file. I think is worse not to do anything. I just read in another thread that the same was happening to a girl, she called and got his interview schedule the same day.

Of course, that is what i said applicants need to take advantage of the limited resources USCIS has and hope for the best. After all, what can you do?? You can only do so much. In my own experience, of all the tier 2 officers i talked to, none of them told me the truth, some said i would get adjudicated in 2 weeks, some said my case was transferred, and none of what I was told was true. I talked to at least dozens of tier 2 officers over the past 2 years. They just can't be trusted, but that is my own experience. Yes, occasionally, you can find a human being at USCIS,, but you might have to find this "human being" who happens to be your adjudicator so it will work to your advantage, but the chances of that seem to be rare.  Every case is different, some get lucky, some have been waiting forever, but majority of 751 applicants waited for a long time to get approved or still waiting. It is unfortunate.

That is also a big problem. Trump's new memorandum that will start on 9/11/2018 also suggests to USCIS to eliminate REF and reject applicants if the evidence is insufficient and places applicants in deportation proceedings. Maybe USCIS will just return or reject your application if there are missing supporting documents or errors in your application after 9/11?  :huh2:  That'll most likely delay your application process since they often request for REF after months/years of your initial submission date!  :no:

That doesn't mean it is going to happen, but Trump has suggested them to do so. The officers still have the discretion, but it certainly a new guide line that is obviously designed to slow down or stop the legal immigration. After 9/11/2018, adjudicators are legally allowed to reject you once and put you in deportation proceedings. It is scary, but that doesn't mean it is going to happen, but it could happen due to the new memorandum. The processing time for 751/400 at field offices is anywhere from 1 year and 5 months to 2 years and 9.5 months as of now.

Theoretically if you get denied, but I don't think you will be that unlucky to get an adjudicator that happens to be a Trump loyalist.

Are you sure this new regulation apply to us? We applied way before, that should be for the new people doing it now. That's the way I see it. Am I wrong? Same thing for the times...those new extended times are for the people recently applying...Am I dreaming here?

I am not sure if it applies to people who apply before 9/11 or it will affect applicants whose applications are received after 9/11

I am in the same situation. Did you open the ONLINE ACCOUNT to track your process? I did the paper filing, but when you open the account it's suppose to show your N400 applications. Mine doesn't. It says 500 ERROR. That's why I am scared, since my app was paper, maybe somebody was in charge to upload it and they din't do it and that's the reason for the ERROR message. Hope I am mistaken.
