The thing is I have no good reason to reschedule. I don't think "my wife cannot come with me" is a legitimate reason. 

If they need to interview her, won't they just send her a letter later?

 

I would go with her if I can, the thing is she is also worried of ending up sitting in the waiting room for 2 hours needlessly.

Its ok, we can be honest, we all hope to avoid an interview the second time if we dont have to, the marriage can be a billion % true but no one wants to sit and be questioned with their spouse about everything, risk a misunderstanding causing headaches when it doesnt have to be, its a normal anxiety response that we all would like to avoid if we can. 

 

The reason I say this is, dont give an excuse to an officer if asked why she isnt here. Tell the truth, you did t recieve a letter saying she needs to come, period.

 

Excuses like she doesnt want to wait 2 hours needles are not good to be blurt out in important life decisions as these. 

 

No one is assuming we are sitting around in forums figuring out what people are doing with their cases. 

 

You are communicating with a gov agency, if they want someone to come, they can mention it in the letter

Think of it the other way - if she IS required, and doesn't attend, then expect a denial.

Then again, my I-751 interview letter explicitly stated that the USC spouse was required to attend (despite having already informed them we were divorcing....bloody template letters). 

 

If it doesn't say it, then it doesn't say it and I would be inclined to think that she isn't required. You have the letter to back you up if necessary.

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

As everyone mentioned it would be better to go with your spouse to the interview. Since you have a pending I-751. Having said that if your spouse for some reason cannot go with you to the interview I assume the IO will ask more questions and dig deep. It's right that that letter does not say to bring your spouse and the IO might not inquire about your spouse who knows.  If I were you I would absolutely go with my spouse just be on the safe side. Hope you do well, best wishes.

I think it would be easier to sit in the waiting for 2 hours needlessly than to risk waiting

several months to reschedule the interview.

You should just take your wife there. To be honest, you need to prioritize your citizenship at this point. I had to try to prove to USCIS why my husband could not go because he was basically dying and was too sick to go and I was pushing for immediate swearing in and the approval of 751 and 400, I submitted a big packet of doctor's letter and a central argument to the district director based on humanitarian ground arguing if it weren't for anti gay laws prior to 2013, we would have been able to get married a long time ago, and my husband would have been able to fulfill his wish to see me become a citizen. I knew my husband for 21 years. The officer was somehow sympathetic, but he was already telling me about rescheduling even after I told him the serious nature of my husband's medical condition by proving it, and 3 days later my love passed. They could not reach a decision, I was finally 751 approved a month later and got naturalized just 8 days ago. I had to submit my husband's death certificate and request to switch my 751 application from a joint one to a windower's waiver application, If my husband were able to go, I would have probably gotten a approval recommendation. So that being sad, I don't mean to tell you what to do. Which one is more important, your wife's field trip or your immigration status? You do not want to take any chances of having your applications delayed, if your wife can't go for whatever the reasons, they will probably reschedule your interview and you can expect another 3 or 4 month delay. Why run the risk? I would just drag her to the interview because that is more important unless you don't mind potentially waiting for 3 or 4 months. Good luck.

You should meet my wife and tell her that! I cannot drag my wife anywhere. She made up her mind to prioritize the class field trip and doesn't seem she want to change that regardless of what anyone says.  

It seems that I will have to just take my chances.

the letter is for N400 which doesn't require the spouse to be there, but if you have an I751 pending, absolutely take your spouse. My friend had to call her husband as they wouldn't approve her N400 without the ROC being approved, and for the ROC, they need the spouse.

In other news, I received an interview notification today. The status only updated on egov.uscis.gov. Nothing on my.uscis.gov yet. Waiting for a letter (paper or pdf upload) to see the actual date.

Can you elaborate on that case please? Did the officer interview her over the phone or did they drive there after the call?

 We had an impromptu (without formal notice) I751 interview when my wife had her N400 interview.  Whenever I see the question, I always recommend the spouse attend particularly when filing on the 3 year rule and especially with a pending I751.

yes persons have been approved before because the IO said they submitted enough evidence for them to proceed and approve both however its very rare. not a frequent occurrence at all hence why we all advising you to try your best and have her attend or even have her send in a document with you explaining why she could attend and asking that they please don't hinder the process by her absence and to accommodate she would be happy to take a call if they can cause they do sometimes call in your presence or when you leave and also approve so try to be prepared for every eventuality
