Congrats Soapface. I wish you get all the approvals soon this week.

I am in the same situation as yours. Can I ask if you prepared any docs regarding I 751 to your citizenship interview? And what did you bring for the interview?

Thanks in advance!

I brought a few documents with me but he didn't ask to see any of it. I brought my marriage certificate, tax returns, life insurance document, joint bank account statements etc. The only things he asked for were my drivers licence, expired green card and passport.

Did your spouse have to attend the interview as well?

No, INA 319D clearly says the spouse needs to be around when the applicant is taking the oath of allegiance, will have to reapply next year, I will just get my 10 year green card after i submit my late spouse's death certificate.

Unfortunately l, no, there is no humanitarian ground on this, I may be eligible if Stan died as a military member who was in active duty, that is the only exception.

Thanks, the humanitarian ground can only be used if the applicant and the American citizen spouse are alive which is why I pushed so hard to try to persuade USCIS by submitting an expedited oath request during the interview proving Stan was dying and critically ill. If they didn't buy my request then, they should believe now sadly because Stan died. I would be waiting for my oath if they granted me the request on the spot. I tried and failed. I am angry and grieving at the same time, but nothing I can do at this point. Here is the INA 319D. The section of the law could not be more clear and it does not apply to me at all. d) Any person who is the surviving spouse, child, or parent 2/ of a United States citizen, whose citizen spouse, parent, or child 2/ dies during a period of honorable service in an active duty status in the Armed Forces of the United States and who, in the case of a surviving spouse, was living 2/ in marital union with the citizen spouse at the time of his death, may be naturalized upon compliance with all the requirements of this title except that no prior residence or specified physical presence within the United States, or within a State or a district of the Service in the United States shall be required.2/ For purposes of this subsection, the terms "United States citizen" and "citizen spouse" include a person granted posthumous citizenship under section 329A ." Oh well, I will just have to reapply as an individual next year and give Stan a toast when I am a citizen in 2020, I will be eligible again by early August next year.

Update:  Katya had her N400 interview today, but before that started, the very nice IO at the Detroit office invited me in as well and covered the I751 with both of us.  Other than updating our tax records and verifying some of our information on that form, it was a five minute interview.  Then I left and Katya went through the N400 interview and passed with oath to be scheduled later.

Good Luck to everyone!
