Timeline

My wife has her N-400 interview scheduled for July 25th.  I will be going with her due to the pending I-751 but reading some of the stories here make me a little worried. We also do not have any children (though we have talked about it, it's hard to do where we live) though we do own a house together (which is almost like having a kid to be honest).

 

Anyway, we're just surprised it was so quick (she just applied in February). I was sure her case would be slow rolled. Glad I was wrong.

At the end he said will email me a RFE to proof how I rent my place and send W2. Its't weird???

Could you please explain what permit from the bank is IO talking about? What if homeowner owns the house (no mortgage) and rents it to you. The lease document needs to be signed by all renters and the home owner. That makes it a valid document.

I'd guess that IO is just giving a hard time to give a hard time. Meaning perhaps not thinking of denying you, but just adding more work and process and time to your case for whatever reason (bug up their nose).  I wouldnt worry, and would simply look to provide some more paperwork on the rent, perhaps an affidavit from the owner, monthly checks shown on monthly bank statements, etc, along with utility bills.

I have no idea what he was talking about, I have a lease agreement from the owner of the house and he was saying it's illegal to sublease. I said it's not sublease he is still living with us. He said where is the transaction of paying him, I said I pay by Venmo. and he didn't want to see my phone. then he said where is the proof of he is the owner of the house, I said  I have no proof, this not my business, he rent me the place I pay him rent and we have lease agreement, that's it.

then he checked my tax return and ask how much you was making this year and this year, I didn't really remember the exact number, then he asked where is W2, I said I have already tax return why I need W2.

 

then he drives me so frustrated. then he moved to N-400 and at the end said you will receive a letter asking for this documents.

So, what I recommend is to get a letter from the home owner where he states that he is a home owner, that you indeed pay him rent by Venmo. Make sure to put a notary public stamp on that letter. Submit your w2s. That shouldn’t be a problem I assume. I’m really hoping you’ll be approved soon. They literally just giving you hard time based on nothing...

Thanks, I know it's not hard to get this information, just why people acting like that without reason. One more thing, at the beginning he said Do you have I-751, I said yes it's still bending, so he said why you applied for naturalization while you still in removal condition case, I was like huh!!!!!!!!

Hi @mz_066  Sorry to hear that. Do you mind elaborate on the leas issue IO addressed? I submitted several leases including one lease from my friend / landlord who rent us a room, I dont know if he put that income in his tax filing, do you think that would be a problem? This is literally the first time i see someone posting such issue from IO for I-751... I hope you get the good news soon! 

 

Also I didnt submit any W2, only TAX return and tax transcript for every year... my lawyer said ok, but now im worried!

it's not a problem at all, he just give me hard time for no reason, if landlord didn't declare this income into his tax this not my problem, I pay rent, he give me a space, that's it.

just try to take some proofs that you pay rent and W2 as well in your interview.

I wonder how an important role W2 plays in the whole "tax evidence documents"? The W2 forms for me and my hubby have all different addresses, one of his has an address we intended to move in but did not at the end, etc.  My I-751 lawyer said as long as i have tax return + tax transcript from IRS, its ok not to submit W2.

Hey guys,

I filed my I-751 on 11/9/2017 (and my N-400 on 11/10/2018).   My I-751 status has been "Case was received at my local office" since 3/4/2018.   Also my N-400 status changed to "Case was transferred to another field office for review" on 5/17/2019 (I don't know the reason!).   When I went to my local office for my infopass to get a new stamp,  they told me they don't have my file!   I'm wondering if anyone has similar experience or knows what I can do to find out what's going on with my application at this point?

You should be well within your timeframe to submit an inquiry on your case by now. Or see if you can set up an InfoPass appointment

Having a house together is a big deal. I would say bring all the other evidence recommended for the I751 interview, and you should be in good shape. It bothers me that some IOs seem to put too much emphasis in having children as if that superseded everything else. That said, child or no child, I think most IOs will look at the totality of evidence.

I have a feeling that even though the N400 processing times are much shorter than the I751's processing time, the N400 application actually delays the I751 adjudication. But in the end, it shouldn't matter that much since you end up getting the citizenship sooner. But I agree with you, contacting USCIS to give them a nudge is probably a good idea. In my case it didn't make a difference; after contacting customer support by phone, it took a month for me to receive a letter saying the I751 is "under review".
