I agree with you. I remember when me and my husband went to our interview for the AOS in 2015 the officer told us starting from now start collecting evidence for the ROC. It’s better that way than having an RFE. So we dor what he told us and ended up sending about 6 to 8 inches thick folder.

Exactly, It is never an overkill to be prepared. USCIS is unpredictable. I don't know if they have opened my 751 since they have merged it with 400, but if the officer says he is going to have to review my 751 after I pass the 400 interview, I will definitely ask the officer if he needs additional evidence because I will have had it handy, and that binder of evidence will be the same evidence should they request an RFE if they want to see more evidence, so why not cease the opportunity and provide the option for the officer? In that hypothetical, I might just save myself 1 or 2 months of waiting and getting an RFE later. Not saying it is going to happen, but always have to be prepared since I have the opportunity to be face to face with an adjudicator.

Exactly. I hope everything will goes well for you. I wish you good luck. Don’t worry everything’s gonna be fine. I was really worried after my N400 interview too because the office said; I might sent you a letter for RFE and schedule you  for an Interview on your ROC. Good thing it didn’t happened. Thanks God.

Also you’ll never know what’s gonna happen during the interview every officers are different. Like mine, everything I submitted along with my n400 application are photo copies even the 3 year tax returns because all the originals was sent during my ROC. Lucky me he didn’t ask anything from me or look for originals.

Exactly, every officer is different, some are difficult, some are not, but my attitude is doing the best you can to convince the officer your marriage is real, the burden of proof is on us.

Yes, I get the convincing thing but if things are 100% legit then the proof is in the pudding and it should be evident in the initial evidence submitted in the I-751 and then N-400.  I guess your in a peculiar situation with the same sex and the age gap.  It's unfortunate but it is what it is so I get your being cautious and proactive.  Good luck!  And hang in there....19 months, that's ridiculous!!!

I have a good feeling that i may not have to ask the officer if he needs additional evidence because we submitted so much evidence, but like I said, it is just for the sake of precautions. I will be there legally representing myself,(I have a lawyer, but I am not going to pay additional fees for my lawyer to go to the interview with me, I can handle it myself) so I am going to have to be firm, not confrontational, respectful. My husband is already 89 years old, he had a few minor strokes before which might have effect his memory, so we will have a medical letter from his doctor proving his past ministrokes and their potential impact on how he answers the officer's questions(If we get called in for a 751 interview), then we will have the dr's letter handy so they won't hold my husband's some inability to answer some questions due to his age and medical condition against me/us. I am just being prepared since USCIS could be unpredictable, but I think as long as we are prepared, we will most likely be fine even if things get a bit rough on the day of the interview. Yes, 19 months, insane, but the minute I applied for 400, I kind of knew they would delay my 751 and it happened, but the scheduling of the interview is way faster than the processing times suggest, so I am grateful, and I think i am quite lucky, I got an interview date only 6 months into filing my 400, that is like normal for my field office in LA. We still have folks here who are still waiting for 751 after 18 months without having applied for 400, that is insane. If i didn't apply for 400, i might still be waiting for 751...

He said HE "MIGHT" send you an RFE? I remember you told me he was kind serious and kind of complained about having to adjudicate your 751. I think he was on his power trip a bit and later on too lazy to really make it difficult for you because you had enough evidence!!LOL

Yes. I am glad that he didn’t. There was like 2 thick folders about 3 to 4 inches each. He told me it’s  my I751 file. Lol.

You mean the two thick folders were 751 and 400?

I would say that was my i751. My n400 was very  thin. Not even a half inch.

Ah, one question. When you were greeted by the officer? Did he ask you if your husband came with you or you volunteered to tell him your husband was there with you?

No he did not but I believed he saw us together because the front desk people instructed us to seat in the front of the door (c). They had different doors. My husband and I was talking when he came opened the door. Didn’t even say good morning to me but I greeted him and never responded 😂

LOL. Kind of typical for someone in that position. Could not even be polite with you.

After all that has been provided for the I-751 and the N-400 what more does one need to prepare?  Haven't we prepared enough and submitted enough for these applications?

Am I missing something here?

I would suspect if one still needs to prepare for the interview they are going to need more time than one month. No?

The question for me is: Since it will have been almost 1.5 years since we submitted the I-751 paperwork, what is the interview like? What kind of questions would they ask of us at the I-741/N400 Interview?

Also, what paperwork is needed for the N400 which we will be applying for in three months time?

The thing is you can have things that are 100 percent and legit and the officer might still give you a hard time due to the officer's view on homosexuality and social issues. Just like African Americans in this country, if they can be stopped by the police due to the color of their skin, if they can be harmed by law enforcement all because of racial bias and misunderstanding, if a good number of people believe president Obama is not American no matter that? What  makes anyone think LGBT immigrants are 100 percent safe if they play by the rules and submit everything legit(like we did)? Then our fear of running into an adjudicator that is biased is real and should be understandable, not saying this is going to happen, but it is just the way it is in this country, minorities in this country might always have to work extra hard in order to be understood and treated with respect, and I believe immigration is no different. My husband and I have been together for 21 years, but we could not get married until 2013, so our goal is to overwhelm USCIS with strong evidence to possibly offset the possible bias and prejudice. I have confidence we will be ok, but we have to be cautious given the social and political circumstances we are in.
