no

too many inconsistencies, from the other post, the answers should have been exactly the same at the interview with your spouse

from a daughter that isn't yours during the marriage, to trips to Jamaica, credit cards and other things

each one of you stated totally different things, that's not a bona fide marriage, so the removal of conditions has been denied and you may be put in deportation or receive a letter to leave the country

Is this case fixable?

it's possible with a really really REALLY good lawyer.

However it appears that you were denied for misrepresentation.  Not an easy thing to fix, and way too many inconsistencies/withholding information in your case---specifically the existence of your daughter----as outlined in the letter above (and the full letter in your other post on this topic).

We didn’t withheld or lie that there was a child , it was stated from the very beginning.

The page on your other post states that your daughter, who had been born at that point, was not mentioned during the original adjustment of status process. That is what is being referred to as withholding information, seeing as the paternity is not from this marriage which would have been a red flag at that stage of the immigration process it is being seen as having been an intentional concealment.

Under ordinary circumstances, some of those things listed in this post and your other could be explained away: for example, neither my husband or I use debit card for our bank account - we've just never bothered to activate them.  However, we did submit joint credit card statements showing that we did both use our separate cards.

I could also see my husband being unable to answer questions about when we opened bank accounts, etc.

The biggest problem like PP has said is the concealment of the child at the first interview, and not knowing how long you've lived at an apartment for, and other general inconsistencies.  It sounds like your ROC evidence was extremely weak to begin with and what you did submit only showed that the two of you don't really have co-mingled lives.

At this point, you need a lawyer as you've passed the DIY part of immigration right by with willfully omitting evidence, not properly providing ROC evidence, and having different answers.  I shudder to think of what a Stokes interview might have gone like.

We never hid such information. At our first interview we talked about her, clearly the interviewer didn’t read our file .

This is something you and your lawyer will need to address with USCIS.

If you talked about her in the interview why  was it an error in the interviewer not reading your file? Wouldn’t you have said our daughter who is called x is not the husbands child but is the daughter of y and here is a birth certificate to show that?
