Information about beneficiary

On the part where it says "provide information about beneficiary's spouse and children" are they asking about the beneficiary's biological  children? I the petitionor has a daughter (I took her legally from my sister when she passed) . Beneficiary is not the father, so i'm absolutely confused with this question.

 

So i the petitionor has a daughter.

Beneficiary has no children

 

Please just give me a straight answer. I get to many answers with individuals trying to be sarcastic or rude.

Not quite.  The section in question asks about spouse and children of the beneficiary.  This beneficiary has a spouse but no children.  The section asks nothing about the petitioner's children or the beneficiary's step children.

When someone hasn't even filed the I-130 and are asking questions about it, then likely they don't have much of a timeline to speak of.

And then follow this principle going forward.  Read carefully, interpret literally and answer accurately.  Do this AFTER you have become an A-Student of the form's instructions.  Each form has instructions that are pretty detailed, however, this particular question stumps lots of folks.  The I-130 is used for many different alien relative categories.  If you were filing for your father, HIS wife, (perhaps your mother) would be listed as spouse and YOU would be listed as one of your father's children.  If his wife had children that were HIS step children they would not be listed on the petition for him.  They would be listed on HER petition and HE would be listed as her husband.

 

YOUR, refers to the petitioner regardless of the relationship, followed by listing the beneficiary's spouse, if any and children, if any.
