Hi Everyone,

My new husband was on a J1 Visa (no 2 year requirement) and we are currently going through the AOS process concurrent I-485 and I-130 filing. I have a few random questions about some of these forms.. This is intimidating and I'm terrified of messing something up and causing a delay in processing!  Any help is greatly appreciated!!!!

 

1. Form FC-029 - Is this still required? I'm thinking not...

2. A Number  - He was issued a SSN at the beginning of his J1 visa, so we've been putting that on the forms, but it asks for an A number so many times I'm getting worried with the concurrent filing we should have this?? Or can I just leave that blank on both forms and only list the SSN?

3. I-485 - "Receipt of any underlying applicable petition" - I'm not sure what this means.. Would this apply to us?

4. I- 864 - Having trouble with the autocomplete when filling this outline where it adds up the number of people you are sponsoring plus yourself to get your total household size. It won't let me type anything in the "Persons you are sponsoring line." I was thinking I could just type it in on the PDF and then change the total to 2, but I don't want to screw up the generated barcode if this is going to be a problem.
5. I-864 - For proof of my income to support on the affidavit, can I submit a copy of my 2016 Turbo Tax filed federal return, sign it, and then include my corresponding W2?  Just want to make sure that will be acceptable to them.
6. Lastly, the instructions all seem to say put "N/A" on every field that doesn't apply, but the sample Visa Journey forms just leave fields that don't apply blank. It seems like overkill to put "N/A" every single time, but again,... I want to make sure I'm doing this right the first time.

I just filed for the same reason - I was on a J1 visa and married a US citizen. So I'll try and answer your questions the best I can.

1. No. You need I-130, I-130A, I-485 and I-864. Additionally, I would advise you to also file I-765 (employment authorization) and I-131 (advance parole).

2. If he hasn't dealt with USCIS before and has no petitions, he doesn't have an A number. I just left it blank everywhere.

3. This wouldn't apply to you as you are filing I-130 with I-485. So there are no previous petitions for him.

4. I'm not sure about this. It worked fine for us. Maybe read the instructions on USCIS again. I think you can also write it in black ink. I had some lines in which the pdf form wouldn't allow me to type so I added it in later after printing it out.

5. You have to submit your most recent tax return and W2. If you are on a salary position, you can get a letter from your employer stating what you make as well.

6. I;m not sure about this. I just left everything that didn't apply to us blank. Didn't even think about putting N/A. Oops!

11/21/2017 Received biometrics appointment notice scheduled for 11/29

12/15/2017 Interview notice - interview is scheduled for January 19th! Holy #$%^ that's less than 3 months from PD!

01/02/2018 EAD + AP approved

01/16/2018 Combo card delivered

01/19/2018 Interview - recommended for approval

01/22/2018 New card is being produced :dance:

Thank you so much!!!!  I've heard that some people put NA and some people leave blank and it seems like they accept it both ways - so you're probably good :)

 

Did you submit a certified official copy of your marriage certificate or is it ok to submit a photocopy copy of it??

I submitted an original but I got 3 from the court so I used 2 for my application and kept one for me!

They are only $2 each here anyways.
