I agree with others that it would be best for them to remain where they are at until the sisters are of age.

 

It was your decision to migrate to the US. To be reunited with your family in the way you claim, the easiest path would be to return to your home country. 

 

Student visas are usually for College but there are cases where they can be in hghschool (usually private school). Be warned that you will be obligated to PAY for the schooling even if it is highschool. This means you will have to have evidence of funds for the school year (or 2).

 

ETA: The sisters also can't go to school on a VWP or tourist visa also. It is not permitted.

I would get details of which subjects she is studying, expected grades etc and ask how that would fit in to their system.

I agree with boiler on this. Moving at that age is traumatic enough, halfway through high school to a totally different system is going to be really tough. It’s not just the subjects, it’s how they do them. My older child moved just before high school , from a curriculum that was essentially British (British system private international school) and thst was difficult enough. If she moved at this stage (she’s 16 and a junior) I think she would really have struggled - she’s bright, but the system is totally different.

Hi there! I am in the same boat as you. I would like to petition for my mom's IR5 in May next year but she has a 15 year old adoptive daughter. I really want them here with me.

Nope. My plan, after listening to many people's advice on the forum, is that I'd petition for my mother first and then she can petition for my sister. I plan to have my mom stay 6 months in the US and 6 months in Thailand while the USCIS is processing my sister's petition. Doing so, mom can "partially" be with my sister back home.

Your mother will only be able to bring over an adopted child if both of the parents are dead.  Just make sure you look into the US laws regarding adoption and immigration otherwise your plan will fail.

This response has been nagging at me ....you are framing this in terms of what is best for you and your “own” family, and that you “believe” the best life for your mom and siblings is in the US. Do they believe that too?  Are your sisters happy to have everything they know ripped up and left behind, exactly what you don’t want for your own kids? In short, do all your family members actually agree with you that reuniting your family and doing so in the US is the way to go?

Yes this is a family decision.

 

The point of my comment was to say that me going back is not an option, for essentially the reason you are worried about I may be pushing my sisters/mum into a path they don't want.  

 

My Children and wife and yes myself love America.  To go back to UK for us as a family is not something we would want to do.  The driver for them to come to join us in the US is not me but them.  Again however I will be the first to say having them here would be amazing.  Obviously I am writing the posts here so everything will be tainted with my own bias :)

 

I found the stuff on the reentry permit as well and I think that this may provide the best legal option during the period where she is sponsoring my sisters to come to US a well.

the only thing about this process that still confuses me is that I thought you had to show domicile in the US to sponsor family members so I’m not sure how your mom will do that while living in the UK on a re-entry permit, but other posts above seem to indicate this has been done before.

People can keep domicile and visit other countries for up to 2 years at at time, which is the point of the re-entry permit.   As long as you don't claim benefits that are only available for residents of a country, or you don't file your taxes in that country as a resident, etc... and make sure that you do file your taxes here, keep a home, bank account, driver's license, etc... you can claim that the USA has always been your home, you're just away from your home in the USA for an extended period of time for valid reasons.

A re entry permit is a bit more complicated than that and I am sure somebody could write a book on it.

 

Obviously first you need to be resident and that you are not abandoning your residency.

My understanding is that what you are referring to above is residence, not domicile. The primary purpose of doing all the things above is to maintain residence so as not to lose your green card.

 

anyway I just did a quick search and it seems there is indeed a legal distinction between residence and domicile. https://www.***removed***/affidavit-of-support/country-of-domicile.html

Anyway I’m certainly no expert, but, I hope the OP looks properly into all the legal options and manages to make it work.
