Should I disclose this on i129F form?

Hi Everyone, 

 

I am getting ready to file the i129f form on behalf of my fiance and I. Since I am the petitioner and the USC there is a question asking if I've ever been arrested or convicted. About 7 years ago (I was 17 or 18) I was arrested for shoplifting. I was taken down to the police station and was finger printed, and mug shot. Afterward my parents picked me up. I then had to go to court a few weeks and I think everything was dismissed. I don't think i was ever convicted as i did not have to pay a fine or do any community service. Should I disclose this and answer "yes" or should i not? Please help, i'm kind of freaking out about this.

"Have you ever been arrested, cited, charged, indicted, convicted, fined, or imprisoned for breaking or violating any law or ordinance in any country, excluding traffic violations (unless a traffic violation was alcohol- or drug-related or involved a fine of $500 or more)?"

 

A conviction is not needed. It should certainly be disclosed (they will see it anyway during the background checks)). Your fiance should be aware of it, but otherwise it should not be an issue.

Yes, the above comment is correct.  They will see all arrests regardless of outcome.  Don't worry it will cause a problem.  A bigger problem is always glaring omissions.

I had an 8-year-old DUI and disclosed it.  Heard nothing more during the process about it.
