Me and my fiance just started the K1 process and once we've been approved and gotten married we plan on filing form I-485 as soon as possible to adjust status. We'll also send in the permission to work and travel forms. My question is how long does the permission to work permit last? Does it last until you've officially received your "green card" and if not what's the process of renewing it? My fiance wants to work asap so he can help me financially. I know it should only take them roughly three months give or take to send that since that would allow him to contribute by paying taxes so it's beneficial to get that sent out quickly. I know the adjustment I should imagine would take some time to get done. Really hoping someone could shed some light on this...:D

The EAD card will be valid for 1 year. If you don't have a greencard by then, send a new work authorization application (no fee) sometimes in the 90 days before it expires.

Another option to consider if working is important is the CR-1 visa. This allows your husband to work from the moment his passport is stamped at the airport when he arrives. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

It doesn't roghl take 3 months to get the EAD at the moment, it takes roghly 4 months and some think it'll take 5 months in a near future. Let's hope the backlog is gone by the time you file for AOS

 

Like ohers have said, the EAD is valid for 1 year from the approval date and you can keep renewing it until you receive your greencard. The renewal works the same way as the first time you file, so that's the easy part. Once the renewal application is received by USCIS your old EAD will be extended with another 180 days from its expiry date, meaning you can keep working even after the expiry date on the old card, while waiting for the new card.

Ok, I haven't checked it. To be honest I was just assuming it wouldn't take a long time. 

 

So, does it cost a fee that you know of to just keep renewing it?

I always thought you had to renew it over and over until you became a USC. So it's good to know you can just stop worrying about it until you get the GC.

Oh, I'm not sure...from everything I read it was my understanding that once you had your green card that was your permission to work....can anyone shed some light on this?

The Employment Authorization Document (EAD) and the Advance Parole (AP) allows you to work and travel abroad while waiting for your greencard to get approved. Once the greencard is approved those to documents become invalid. The greencard is then all you need.

 

Those don't cost anything if you have a pending i-485 (or if you file for both of them together with the i-485). Same with the renewals, they cost nothing, you just need to send in proof of pending i-485 when you apply.

 

So again, the EAD and AP are only temporary documents you can use while waiting for your AOS to be approved.
