Hey there,

I'm new to this forum and I'm hoping I can receive answers to my questions because the uscis certainly can't.

In July me and my wife had submitted my i485 and my i765. I soon received my receipt notice. I had my biometrics in late August and a day later I received an RFE regarding my wife's income. (Keeping in mind it was a request for initial evidence). We submitted the documents and they received it on September 6th.

We are yet to hear from them regarding the matter. November 5th with be the 60 day processing mark so we are hoping to hear from them before then.

Now, the evidence they were requesting were regarding my wife's income. They stated that it wasn't above the 125% guideline mark and that we had to provide proof of her income. Examples they were requesting were her tax forms, w2s etc, letter of employment etc etc.
(My wife earns around $30,000 a year compared to the 125% of which is around $20,000)

Also, she had only started this job in January of this year so she was unable to provide any form of tax proof regarding her new role. Such as w2s.

Now, we had sent in a proof of employment letter from her HR department containg her yearly income, hours she works, start date, role and it had the company's address and contact information. It was also signed. We had also provided 12 months worth of banks statements to support it. We never sent in the tax returns for the RFE

We had initially sent in the 2015,14 and 13 tax returns when we sent in the forms back in July. She did not provide the 2016 forms as she did not work for that year so it was unnecessary. (She had provided a letter with the RFE explaining why)

My question is, the evidence we provided for the RFE......would it be sufficient?

I've read online that the tax forms don't really impact anything other than they just want to know that you pay your taxes.
More importantly, that the only income that counts is the year that the forms are filed. Is this the case?

I'm growing more worried by the day as I'm growing more paranoid regarding how long it's taking. I don't know if it's a good sign or not.

I'm wanting my EAD card asap but it's just taking forever. I'd like to support my wife but in not being able to do so, hurts me, mentally.

I'd appreciate all forms of responses. I'm very grateful to anyone who takes time out of their day to help address my concern.

Thank you and God bless

The best form of proof to prove income is with an IRS transcript of your taxes.

However you stated that you provided an employment letter, with bank statements / and i'm assuming any pay stubs your wife had.

This should be good enough to prove income.
