My fiancé was still married (on papers)when we star dating!!

Hello everyone, I have an important question, when I first met my fiancé he was still married, he starts his divorce process some time after we start dating, we even got engaged and after that he did the divorce, he wasn’t living with her and they both decided to end it up.. may that be a problem when they ask me when we start our relationship and they see that he was still married at that time?

What country from? When was the divorce official? Some countries tend to have more of an issue than others. If his divorce was official lets say Sept. 1st and the petition was filed Sept 2nd - that may look a little off. 

 

Try to focus on proving your bonafide relationship - most people know that divorces take time, some countries they take more time than others - but whichever of you is the beneficiary should be prepared to discuss this if it comes up and they are asked.

Dating while still technically married usually isn't an issue. However, it can look suspicious if you were dating before they separated (even if not legally separated yet).

 

But as stated above, focus on proving the relationship is bona fide. Don't focus on the past marriage...let them ask about if they want (and be ready to answer and know about it), but just present evidence that supports your case.

Divorces take time , my husband and I were dating for over 2 years while I was still technically married to my ex husband . We had been legally separated for several years but my country makes it hard to divorce if you have kids under 18. I wasn't ever questioned about it . I had been divorced before my husband proposed and before we filed for the K1.

If he was divorced last year you will be fine Just be honest about your relationship don't ever lie . Explain how you met, how he proposed and your marriage plans. That's all they seemed to ask about. You both just had to be free to marry to apply for your K1 and they already have evidence of that

My wife was still married (separated) when we got together. In NC there is a requirement to have been separated one year before you can apply for divorce, so it took time.

 

Obviously this means her divorce certificate was dated well after we met, and after the dates of some of my trips to the US to see her. This wasn't an issue at all. They never ask about when separation took place (its not relevant to immigration), they are only interested in seeing divorce certificate. So don't worry, and as always just tell the truth.
