"This is to let you know that your fiancée’s immigrant visa case was refused and the file has been returned to U.S. Citizenship and Immigration Services (USCIS) for further review.  The decision to send the petition back for additional review was not taken lightly.  The interviewing consular officer reviewed the case in its entirety before making this decision, and the consular supervisor also reviewed the file.  At this point, the consulate is unable to take any further action on the case as we no longer have the file" I received this email from the consular in Casablanca, the reason why I think because my fiancé was asked if I was married before and she hastate, please let me know what to do next? I`m thinking about going back home and getting married then withdraw I-129 F and apply for I-130 .

The I-129F will be sent back to USCIS and left to expire. You will need to marry in Morocco and file a CR1 spousal petition.

Make sure your fiancé/spouse knows everything about you and your past relationships for her CR1 interview.

Your K-1 petition will be returned to USCIS and will expire byt itself. They won't process it anymore so you don't have to worry about withdrawal bcs there isn't any. Good luck with CR1!

Thank you
