Hello everyone

We are in the process of preparing papers before the interview; we managed to get a co-sponsor for us. Fiancée's son he lives with his girlfriend and he didn’t include her in his tax returns. I have a question of how to count the number of household members to find out if we are above the 125% poverty guidelines for this year or not?? i.e. will his girlfriend be included in the calculations or not?

You only include the people that are dependent on you, that is the people that you claim on your income taxes, such as you own children. Then add the immigrants. You dont count the immigrant 2 times as spouse and immigrant, they are not counted as spouse on the form, they are immigrant first.

All you need to do is read the instructions with the I-864 forms:

How Do I Count Household Size?

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, the person being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864EZ affidavit of support whom you are still obligated to support.

If you are not using a joint-sponsor, or listing assets, and your income is above the 125% poverty line, consider I-864EZ it is easyer to understand and fill out.

yes, am going for my K1 interview and we are using the I-134 form, sorry if i didnt mention from the begining. My fiancee have some assets to cover the 125% poverty guideline but since she is unemployed (or worked very little as part time jobs in the past 5 years) so we are going to include a joint sponsor , her son. my question will his girlfriend, that he live with, be included as a household member even if he didnt include her in the tax forms?

can you please explain more

for exemple how your assest above level poverty line , how you acount it ,

can you have more than one to cosponsor you

yes, its my fiancee who have assets as money in saving accounts more than the 125% poverty guidline for me and her (2 members), we know it should be 5 times the income of 2 members . But we want to include a co-sponsor cuz she is unemployed.

Where do you see anything about household size, household members, and 125% or the poverty level on an I-134 affidavit or the DS-2000 (formerly OF-167) instructional form for meeting the public charge provisions of the law?

Have you fiancee's son provide the information that is requested on the I-134 and don't invent things that are not asked for.

Yodrak, thanx for reply, but in Q8 of I-134 " That the following persons are dependent upon me for support: (Place an "x" in the appropriate column to indicate whether the person named is wholly or partially dependent upon you for support.)" so if fiancee's son girlfriend is dependent on him as they live together , wont she be included on that question ?? and that will affect the number of household members thus the required income for the 125%.

Nad,

As you have observed, the question asks how many people are dependent on the sponsor. That's all. It does not talk about a household size. It does not talk about needing an income that is 125% of the poverty level for a household size. So why are you talking about these things?

As I wrote before, have your fiancee's son provide the information that is requested. If his girlfriend is his dependent, he should identify her as his dependent on his I-134. If she is not his dependent he should not identify her as his dependent. The fact that they live together does not make her his dependent.
