The title pretty much says it all. We just started the K1 process but I want to have my ducks in a row by the time we get to this step. I checked and I make plenty for them to approve the K1 visa however I'm only a few thousand shy of reaching the 125% for the adjustment of status so of course with my ex husband knowing I'm including the child support he pays me each month. It would put me well over what I would need. I plan on including a notarized letter with him and myself signing stating he pays it monthly and has never missed a payment, our court ordered papers stating what he is required to pay, copies of his checks he writes out to me, and bank statements showing where they have been cashed. 

 

Do I just add this as my overall income since the checks are written out to me OR do I write it in the section for other's income used I.E. "child's name C/O my name"?

 

I have looked into this and despite the 50/50 of people saying yes you can consider child support, no you can not. You actually can. I have checked on the USCIS website. I included the link it's under part 6 and from what I can tell by that I just add it onto my income but I would like to get feedback from someone who has actually dealt with this.

The only place it can go is:

6.2. My current individual annual income is: 

 

You could add a sheet after the form and before your proofs spelling it out to them.

 

INDIVIDUAL ANNUAL INCOME

$16,242 Salary

$  8,000 child support

$10,000 trust fund

$10,000 lottery payout

______________________

$44,242 Total Income

 

(A child under 18 yrs old can't be a family member contributing income to the household total, so that's why not in that section)

I wouldn't use my child support to support "an immigrant". I make enough but I'm about $2000 shy of being at the 125% line and as soon as he is here and we're married he's going to apply to work whiling adjustment of status is pending. 

 

I mean do you seriously not have anything better to do that troll and be judgmental? That's not what this site was made for.

So you mean that I added to my individual income but I won’t be adding my kids nemes and income on part 6 person1, 2,etc?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
