K1 Algeria Experiences - Age Difference

Hello,

 

My fiance and I are getting ready to file for a K1 visa, he's Algerian, I'm a USC female.  We are both Muslim and I'm also of middle eastern background.  His family approves of our relationship and like me very much, and we have photos with everyone. 

 

I'm asking for anyone who has been through the K1 in Algiers experience recently, specifically with these 2 red flags:

 

*    age difference of 20 years: 28 & 48 (me, and yes, I can still have children according to medical tests)

*    I have 1 teenage child, I've been married 2 times (both marriages were CR1, both naturalized, 8 years married both times, both also Muslim)  Yes, I know it looks really bad on paper................ 

 

My 2 previous marriages were real and lasted 8 years, but ended for totally different reasons and nothing to do with fraud on their end.  I'm thinking of briefly explaining about them in our K1 packet since it may come up at some point, basically irreconcilable differences that couldn't be worked out.

 

I'd appreciate anyone who has experience with these 2 red flags to share their experience in the Algiers consulate, of either approval or denial.

Certainly real red flags flashing here.
It is a good idea to write a narration of your previous relationships and including the reasons that the relationship did not last
and why you think this one will last. Go deeper into it than irreconcilable differences. Then narrate your current relationship timeline
and how you came to grow to love each other.
You should marry and do a CR1 instead of a K1 with those flags. We filed a K1 and were denied and filed again and were approved.
I had a previous K1 10 years ago and was drilled about it all the way through AOS for a stokes interview with a home visit and
questions centering on the ex !
It will look like you married just to grant them citizenship benefits and that's what they will assume unless you convince them
otherwise.
If your K1 gets refused and returned it will expire. If a CR1 gets refused and returned you have a chance to rebut their findings
with a NOID response.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I can't comment on personal experiences with the red flags but it's good you're aware of them :)

 

I'd say the two issues you need to address are the age gap and the previous marriages.

 

Make sure you have solid proof both previous marriages were entered into in good faith and the marriages were continuous (e.g. you didn't have a green card setup going with both of them). So things like lease agreements and joint bank statements would be very useful.

 

I'd personally choose the CR1 over the K1 for your situation.

Thank you both.  The reason I'm thinking K1 is because both previous marriages were CR1, so I think a 3rd will look worse than going K1 this time?

Either way is an uphill climb. 
From the standpoint of your chance of refusal I would go with a CR1 because it is likely the K1 will be returned.
Of course you can start over with a CR1 if refused  if you are set on trying the K1 first.

Basically this. You're in for a struggle regardless.

 

The best thing you can do is gather a mountain of evidence on your current relationship and two previous marriages.

 

I would also be prepared for a denial and start looking into the steps you may need to take if that happens.

Thanks everyone, I have plenty of proof that both marriages were real because they were, and either way we file, I will include a detailed cover letter explaining myself.  

 

But as we are both Muslim and I'm also middle eastern, hopefully that will be in our favor.

if you are both middle eastern , a simple picture from the wedding will grant the visa for your spouse , for the K1 you just need to meet his family and provide them with picture and try to be present for his interview

A simple picture from a wedding will not grant the visa.

Wow.

 

If providing a photo was all you needed to be granted a visa then why would anyone ever get denied?!

 

Please don't give out misleading information as it is not helpful to the OP or anyone else in a similar situation that may have found this thread.

Thank you, I believe it's best for everyone to send as many photos and forms of evidence as possible.

 

My main point was that I'm hoping since we both are the same religion and that I'm also middle eastern with an arabic name, that will help in respect to our 2 red flags of age difference and my previous marriages.  If I can stay for a longer vist, like a month, then we may just get married and go for CR-1.
