I-864 Form filling question.

Hi,

I had some really good news on the weekend, we received the Packet with the DS-230 etc. I have filled it all in but now we are having trouble with the I-864 form.

The problem is:

1) My wife is a student and has been living in England for over 2 years, when she was in the states she was also a student.

Does she still fill in one of these forms? or do we just write a letter explaining why my wife has not worked.

2) She has worked part time in England but has not earned a great deal.

Her dad is going to be the joint sponsor and i already have his form.

Do you think we can send the DS-230 with the form stating we are ready to have the interview now, we have everything other than my wifes I-864 form.

Also, I have checked my passport and I have been to the states over 10 times to visit my wife...I have no proof other than the stamps in my passport...will the embassy except this?

Filed: Timeline

The petitioner (the US citizen who files the application) is required to fill in an I-864 even if their income is not sufficient to be a sponsor. So...the answer to question #1 is YES. It does not matter that your wife has not earned much, or that she's a student. She's petitioning for you, hence she has to fill in an I-864 too.
