Timeline

If anyone has been in this situation please help on what to do... My husband AOS is still being processed. My husband had a death in his family so he returned to his home country to be with his family and to return back to the states. He had to leave asap and we didnt know bout getting advance parole or anything like that. Now we are trying to find out how he can be re admitted back in.. I have contacted INS all they told me to do was call borders and customs at the airport he would be flying into in other words they didnt have an answer either. Please if anyone knows how to go about this i would appreciate it. Thank you

Leaving without the Advance Parole abandoned his adjustment of status. File I-130 for IR-1 and optionally 129F for K-3.

05/27/2008 Lifting of Conditions sent (TSC > VSC)

06/03/2008 Check Cleared

07/08/2008 INFOPASS (I-551 stamp)

07/08/2008 Driver's License renewed

04/20/2009 Lifting of Conditions approved

04/28/2009 Card received in the mail

If he has already left the US without AP then he has abandoned his AOS.... you are going to have to file for a K3/CR1 for him to be able to return....

If he has not already left then do not leave without AP you can get an emergency AP from your local office just take evidence of the emergency with you... they will issue it the same day.

You could try pleading the case to you Senators and Congressional Rep. They might be able to help.

Get a letter from the doctors where ever he is, that is the first piece of proof they are going to need.

You might also try an infopass with the letter.

Well John, Kez and john are correct. If the AOS hasn't been adjudicated, then the OP is sunk and needs to start back at square #1.

I'm just wondering if the petition might be approved and the OP is unaware. It's been a long time since they filed.

Possible. I hope so, 'cos according to the OP, the husband has already left the States.

Where is your husband now? Which country?

I'm looking at your timeline and it looks like you filed for his AOS in late 2005?

My husband is in Libya and yes we filed for AOS in December of 2005 and have heard nothing since April of 2006. I have contacted an immigration attorney so hopefully we will find a way out of this mess.
