Filed taxes without an EAD! Is my AOS at risk?

Hey guys!

 

I arrived to the US on a tourist visa and overstayed. It's been several years since then, my wife and I have been married for a year and have since filed a joint tax return. I started work last year as an independent contractor and claimed income on my tax return without an EAD.

 

We're applying for my AOS and contemplating not getting a lawyer, but this is definitely a red flag and we're not sure if things are going to be okay because we made this mistake! 

 

Did anyone have a similar situation?

Are we at risk of having AOS denied because of it?

It's a risk, but not a guaranteed denial -- BE TRUTHFUL about the income you earned every step of the way, and they may overlook it. Do you have an EAD now?

03-19-2021: Officially an American Citizen 🇺🇸 Entire journey from initial K-1 Visa filing to Naturalization took 5 years, 8 days.
