Possibly...depends on the crime.

 

In most cases, no (unless it's an AWA offense). If it's a certain category of offenses as noted on the I-129F, police and court document need to be provided. Either way, the beneficiary should know about as they may be asked about it and potentially even the details.

As stated previously it usually will not be an issue unless it's an AWA offense. Also the embassy will make sure the beneficiary knows about the offenses before issuing out a visa. Also the petitioner has to make sure they enclose court documents before the case will be approved.
