Hello everyone,

 

I came to the US with my two children on a K1 visa and my fiancé and I got married a few days after my arrival. When obtaining our marriage license (we live in Georgia) I was asked if I wanted to change my name, I said yes and that was supposedly entered into the system at that time. A couple of weeks later I got my SSN, at the office they informed us that they had to issue the SSN with the same name as in my passport and I-94 and that later I could have it replaced to one with my married name.

Same thing for my driver's license, it can only be issued with the name of my passport, I-94 and SSN.

We now need to work on our AOS (I-485) and EAD (I-765). Do I apply with my married name or maiden name?

I was reading al older thread on this topic from about 8 years ago but it seemed like for different people it worked differently. Has anyone done this recently?

 Another thing I read on that old thread was about the Advance Parole. Do I need to apply for that as well? 

I will really appreciate any advice on this. Thank you!

You apply with whatever (legal) name you will be using. So if you want it issued in your married name, then use your married name. Just be sure the name is legal for your state due to marriage (i.e. changing the first name is not possible via marriage in the US).

 

It is hit or miss with the SSA....we had to go 3 times to get them to use the married name without an EAD or green card issued.

 

AP (I-131) is highly suggested. Like the I-765, there's no fee when filed with/due to an I-485. AP is not required, but you cannot leave the US (and re-enter) without it until you get the green card, which could take up to a year (and rarely longer).

Take both your marriage certificate and birth cerificate along with passport for ID proof to SS office 

if someone says can't be changed, try another day and different person

we had to go twice and the 2nd man said the frist person didn't know what to do so she had just told us "counldn't be done"
