My husband had his interview 4/9/2019 and within 24 hours we received ds5535 email they kept his passport. Our case is in administrative processing ever since then...our status date changed almost daily for a couple weeks then stopped now the only time it changes is when we send an inquiry...im so annoyed with Islamabad embassy I’ve given up 🥺

Be patient you will receive the visa and it is good sign that they kept the passport. Do not write them too many inquiries. In our 9 month waiting period we sent only two inquiries.

Hi guys,

my wife is in AP for more than 20 months ( spouse immigrant visa). I have no idea what to do, sent numerous inquiries personally and by senator but no avail. Any help or advise will be apprecited. Thanks in advance.

You should file a writ of mandamus lawsuit if your case has been in AP for more than 20 months. I only advice this if ur case is straight forward and does not involve any complications.

Hi guys, is there any way of expediting my husband’s Admin process with ds form if I recently found out I’m pregnant. I would like for my husband to be able to be with me for when the baby is born.

I am going through the same phase. My wife (She is in Washington DC) is due in About 2 weeks and we couldnt do anything so far. We sent many inquiries letting them know our situation but they are not even humans to consider our scenario. We received the same email every time in which its mentioned that we regret to inform u that the admin process can neither be expedited nor neglected etc etc. Even our senator is not cooperative. The only option we are left with is WOM (Lawsuit) and we are considering that now.

Unfortunately pregnancy is not a reason to expedite through any of the the visa process expecially the embassy stage (where there is no expedite).  A W.O.M. is  an option but keep in mind that a writ (although a powerful tool) is not always successful.   Make sure when talking to an attorney they can advice you a success rate at the embassy level.   Of the 4 attorneys I have met with in this process they have had very large success rates with WOMs at USCIS level but once a case is at the embassy the success rates are more rare as they are afforded protection against lawsuits under the doctrine of consular non-reviewability, which is akin to diplomatic immunity.

Pregnancy is not a sufficient enough reason to expedite admin process.  Government will argue that your wife  made a choice to have her baby deliver in the US (which is entitled to) when she could have delivered the baby in Pakistan if having you by her side was that important at the time of delivery.  Therefore, the chance of you getting desired outcome as a result of lawsuit against federal government is less than 1% in my opinion.  Of course I could very well be wrong.
