Extension Tourist B1/B2 for Mom

Hi y'all,

 

I came to the US on a K-1 visa and have my CPR card. I am getting divorced from my USC spouse after 1,5 year of marriage and it's been tough for me.

When my soon-to-be ex-husband left me, my mother was visiting the US, and she's been here for almost 6 months now. She's been the cornerstone in my path to emotional recovery from such heartbreak.

Her I-94 expires in Nov 13th, and her flight back home is scheduled for next week.

 

Do we have enough time to file now for an extension or her visa?

If the petition gets declined, will she face a ban? 

 

I would so much appreciate her presence here in this tough time. Thank you!

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

She can try extending, but really she should have done it earlier. However as long as she does it before the expiration of the i94 she'll be ok. 

 

Keep in mind if the extension is denied she will immediately be out of status and can start facing a ban for an overstay.
