Hello.  I'm 36 years old.  I'm an American and I have been living in the PHilippines for more than 8 years now.  My wife and I have been married for 7 years.  We have 2 children who are both American citizens.  We are planning to move to America now as soon as possible.  I have been working here as an English teacher both in a school and online for 6 years.  None of this was ever reported anywhere and probably doesn't even meet the requirements.  Now,  will it be difficult to use my mother as a co-sponsor?  Will that easily suffice? What kind of documentation will they ask for from my mother.  I don't have any property in the US and will be starting a business there as soon as I get back but currently have nothing to show.  Advice?

You'll need to petition your wife for a IR-1 spousal visa. In order to qualify as a petitioner, you must be domiciled in the US. US embassy in Manila allows direct consular filing (DCF).

 

If you do not currently have any kind of US income, you'll definitely need to find a US citizen or US LPR to be your co-sponsor for the purpose of completing and submitting a I-864. The US petitioner always remains the main sponsor and is required to complete and submit a I-864. The co-sponsor is required to do the same i.e. complete and submit a separate I-864 along with the supporting documents to prove his/her financial abilities.

 

Each person who becomes a sponsor (both main sponsor and co-sponsor) must have sufficient income to cover his/her household size. Your mother's income must be able to cover herself + her other existing dependents + your foreign wife.  To figure out the required minimum annual income for the corresponding household size, please refer to: https://www.uscis.gov/i-864p.

 

For the I-864 supporting documents, your mother should submit but not limited to the following:

1. Tax return transcripts for the last 3 taxation years

2. Letter from her employer, if she still works

3. Paystubs, if she still works

4. If bank balances are used, then a letter from the bank stating when the account was opened, how long it has been opened, current balance etc

5. If assets are used, then documents that could confirm the value

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.
