Hello everyone, 

 

I am trying to work on my form I-129F application to have my fiance come to USA for us to be married. I meet every qualification except for one. "Have you met in person within past 2 years."

 

From what I have read everywhere this is a hard exception to qualify for. However, I have not seen anyone reference my specific situation and was wondering if anyone had any insight.

 

I'm a single father of three children under the age of 10. I have full legal custody of them both residential and financially.  Taking time off is next to impossible, I can even show my accrued vacation hours to demonstrate how little I take time off. Only time off I have taken in years has been for sick children from school etc. Does this possibly qualify as an exception?

That's not really a good excuse. Your situation is basically your fault. (that's how immigration would probably see it) 

 

It's more like you can't visit because it it's a dangerous country or something of that nature. The meeting waiver is ridiculously hard to get.

I have 4 kids, and was the sole provider at the time I met my husband. I managed to find a way to go see him.  It would have to be physically impossible for you to meet your fiance' or you'd have to prove something like religious or cultural reasons for the waiver (even those reasons are usually denied)! We all have faced hardships trying to meet our loved ones. Besides do you really think it's smart to marry someone you've never met in person?

Nope. Either your partner has to visit (tourist visa ) or you have to find time. Having kids and no vacation days aren't a ground for a waiver. Think how many people would use that. 

 

Beside it blows my mind someone would marry another person without meeting them.

That is actually a plus in being able to visit your fiancé. You can also arrange to meet in a third country (ex. you all meet in Mexico or Bermuda - whereever is convenient for all).

Unfortunately, it does not qualify as an excemption you are making a choice not to use your vacation time not to visit your fiance.  Your petition will be rejected and you will lose the money from the fees still have to take a trip and repay for a new petition.

What you are going to find in responses here are people who made sacrifices to find a way to meet the person they love. It may be very hard but you can find a way. Believe us, once you have done it it will be a lot better. My son was living with me at one point so after a few trips by myself I started taking him to meet my fiance's family.

 

There is a reason this requirement is nearly impossible to exempt. You may very well meet the person and withing 30 minutes realize they are not the person you want to spend the rest of your life with. Or vice versa.

 

Do everything you can to find a way. Have family come stay at your place while you are away. You very well may have to wait until you have accumulated enough vacation time to visit.

 

I have only heard of one case being exempt from the meeting requirement and that was due to serious debilitating medical condition.
