October 2017 Concurrent Filers (I485, I130, I131 and I765)

its been quite here. :)

 

Just want to share that today, i finally exchanged my Foreign drivers license to Florida License. Its only valid for 1 year  and can only be exchanged to 8 year if i have the green card. Painless and straightforward process. Took me more than 1 month to sort my SSN :)

12/18/2018: Interview Day | Approved on the Spot

12/22/2018: Received Green Card (10 Years)

Helllo guys :) so i am just waiting to see when is gonna be my interview and my i-485 and i-30 theres no update for 120 days , you guys know how long usually take to the interview ? Because i wanted to travel in June and i dont even have advance parole :( thank you in advance

did you apply for I131?  processing time varies from case to case. :( there's no way of telling for sure when  exactly

Heeey thanks for the answer :) thats the advance parole form right ? If yes no i did not :/ , but i called the customer service and they said i dont need to pay for it cuz i already paid for another form i think i-485 or something, but is it safe to travel with advance parole, for turism what you think , i mean i was thinking about going in June and i am already waiting for 120 days , what you think

you should send your application  soon.. You might still have time. you have 4 months. its "good enough time" but it can be longer than that. who knows. You'll never know. The I131 form is so short, you can finish it within 5 mins and mail it right away.

 

About using AP,If you have a straightforward case and didn't overstay a visa, or a much more complicated situation, i think its fine :)

I mean i am in marriage green card process and i overstayed my tourist visa for 10 months before apply for the green card , but i mean its just a trip of three weeks you think i wil

be okay?

i don't want to mislead you or give you a wrong advise. there is no concrete answer for this. If your case is as straightforward as mine, I'd go out and travel, but if there are overstay issues, that i can't really be confident to say you'll be ok  because in the Avance Parole approval notice it says your entry is not guaranteed even with Advance Parole and its still up to the CBP officer whether to let you back in or not. 

 

Also, You have overstayed of more than 180 days (6 months), i think there are rules that an alien is barred from reentering USA for 3 years. But since you are AOS applicant, that overstay is forgiven.

 

In my honest opinion, and if i were in your shoes, i'd wait for my Green Card approval and not take chances BUT if its an essential travel I suggest looking into Visa Journey if there are some people who successfully returned without problems even  if they have overstay history... BUT ULTIMATELY its still up to the CBP Officer whethere you are allowed back in or not.

So they should be processing Mid November EAD's now? 

 

My congressmen's office put in a service request to expedite my EAD...hope I get it soon. puhhh
