Can I ask you a few questions? I just still dont quite understand how this all exactly works.

 

1.Did both your 1-130 and i-485 get sent to the same processing center? The reason I ask is because I filed my 1-485 1 month after 1-130 after I decided to do AOS instead of consular processing (still concurrent filing and priority dates are both for Nov 6). But my 485 is at the National Benefits Center and my 1-130 is at the Nebraska service center which is really slow. I was just wondering even if I did send them in together  if they would have all gone to the NBC or do everyone's go to different centers.

 

2.When you got notice of your interview, does your i-130  have to be approved/ accepted first, or once your 485 is accepted do all the forms just go to your local office even if the i- 130 doesn't have any updates yet and all the decisions are made at/ after the interview?  

 

Its weird I find because on the case status page, I can check for updates on my 1-485, but when I enter the receipt number for the 1-130 it doesn't register as being a valid number so I cant check for updates to even see what might be happening. (I do have a priority date Nov 6 2017 so they do have it I know that much). going to try to call them again and ask why, but last time, conveniently the phone transfer system was down and couldn't escalate to a teir 2 person. Hmmm...

 

3.If anyone else can chime in, I got a RFIE because I cant believe it... but apparently my husband did not sign the affidavit of support. But OMG. I could have sworn he did. Anyhoo is this going to  boot me to the back of the line, or will they just pick up where they left off. I just sent the signed page yesterday so should get there soon. 

4. How much faster was your time from NOA1 to interview was it compared to what is posted on USCIS processing timeline. Just curious how much faster it was than average.

 

Anyway CONGRATS on your interview and I cant believe yours was processed so fast!!! I am so jealous. :D:D

12/06/2017 | AOS package sent (EAD, and AP as well). I decided to do concurrent filing/ AOS instead of consular processing. The lawyer I consulted scared me initially about AOS and that concurrent is more a sure thing, but I already work here in US under TN and did not enter with intent to marry.

12/11/2017 | AOS package received and received NOA1 for them all about a week later

12/30/2017 | Biometrics Appointment letter received 

01/08/2018 | Biometrics Appointment

01/12/2018 | RFE Received. (I forgot to have my husband sign the affidavit of support. Seriously OMG. I looked everything over 20 times.) Mailed the signed page back 01/13/2018.

01/25//2018 | RFE received. Case update says they will now continue reviewing my case. I was worried I would be sent to back of the line because of the RFE, but it didnt because 6 days later it changed to ready to interview!

01/31/2018 | Online- "case is ready to be scheduled!" Yipee!

02/10/2018 Online case update Interview date May 1!!!!

1. I think they were both sent to the same place and then sent to my local field office. I'm not sure how it would work in your case, I'm sorry!

2. I haven't had any updates on the I-130 yet, but I think it should get approved at the same time as I-485 in my case.

It's normal I think - sometimes some numbers just don't work in the website! Keep trying to contact them but it's  unlikely that they'll fix it. Gotta keep checking the mailbox haha.

3. I think it may delay your case but with USCIS nothing is for certain.

4. I'm not sure what the average is and honestly the average doesn't matter! There are so many different things from case to case that you can never really predict it! For example if your background check from your country is delayed, your processing will be delayed too. Maybe in my case it was a combination of a quick background check and a not really busy field office - Cleveland.

I am currently on OPT-EAD (12 months) and that expires 4/30/18. Not sure if I can apply for the 24-month extension with AOS pending (it also costs additional $410). 

Not sure why I765 is taking so long with AOS. OPT-EAD was approved in 47 days! 

I also got my senator's office to contact them and they told them that 90 days is normal. I'll call in by the end of this week if I don't hear back.

Some people receive their EAD combo cards after they get their green cards.. I don't think USCIS wants it back!

For cases filed at MSC / NBC, it's around 120 days at the moment. To check for yourself, go to the official processing times site and click the 'NBC Processing Dates' button. You are most likely I-765 / (c)(9), which was at priority dates of June 30th on October 31st, based on the update from January 5th. July, August, September, October -> 120 days. USCIS policy is to provide figures from 60 days ago at the point of update. This number may have increased or decreased by now but there is no way to know for sure.

 

Visajourney claims the processing time is around 90 days, but that's based on member data, from a vastly smaller sample set. But, it's 'live' data.

Thanks for the response. Do all I-765 cases need to be processed by the NBC? My understanding is that my lawyer filed with the Nebraska Service Center, which shows a 3 month wait time as of October 31. Of course, I understand that these things are subject to change and unlikely to be reliable at all, but just wondering for curiosity.

 

Additionally, I am currently more worried about the I-131 than the I-765, because I am already on a work visa that is not set to expire soon. But I do have several important international trips coming up that were planned in March because I had expected to receive the AP by now, and I'm getting a little worried about it.

Have you tried contacting USCIS and raise SR. Maybe, you can expedite the processing of your AP just make sure you enough proof that you really need it ASAP. Good luck!
