My application was received on October 4th. I already completed my biometrics, and on November 1st I received an RFE. My response was delivered this Tuesday and I am still waiting for the online case status to change to reflect that they have received my response. Ugh!

Hi,

For which application/form they're asking RFE for? And what are they asking for?

Form I-485.

Oh okay. So it's for Form 864 (Affidavit of support).

1. All supporting tax documentation for the most recent tax year for the petitioner/sponsor.

Did you send complete tax returns or tax transcript for the past 3 years along with W2's, pay stubs?

2. They indicated that my husband's income did not meet 125% of the poverty guideline. They requested us to submit evidence of assets or obtain joint sponsor.

If you guys are planning to obtain a joint sponsor, the joint sponsor must complete Form 864A w/ your husband's Form 864.

Good luck! :)

Thank you, Janice.
This is what I sent:
1.       Petitioner/Sponsor Tax Documentation
a.      Complete 2016 tax return which was actually submitted in my original application package. Husband does not have W-2s or 1099. In 2016 he was living abroad, so he filed his U.S. taxes reporting his foreign earned income (Form 2555-EZ is what I included).
b.      IRS tax account transcript

2.      Joint Sponsor Documentation
a.       Form I-864, Affidavit of Support
b.     Form I-864A, not really necessary because the joint sponsor's income is sufficient. I included it because they file their taxes together.
c.       Their most recent (2016) complete federal income tax return
d.      2016 W-2s for joint sponsor and household member.
e.       Joint Sponsor's employment confirmation letter
f.        Joint Sponsor's paystubs for the past six months.
g.        Their U.S. passport identity pages.

I also sent copies of our bank account statements covering the last 12 months.

Fingers crossed!

Looks like you got it covered when you sent your package. What else they could possibly need?  If you don't mind me asking what else are you planning to send them regarding RFE

I hope so, Janice. Please note that I already submitted my response, so if I missed something I am in trouble.

We are also providing an Excel sheet where we add up the amounts in each account for each month and then we calculate the average. After that, we added the averaged amounts from the three accounts and converted the amounts into U.S. dollars. We provided an online excerpt from a currency exchange converter to show where we got that number from.

Oh, I thought you haven't responded to the RFE yet. :) Silly me! Your documentation is pretty detailed right there and hopefully that's all they need. Good luck to you & your husband. :)

Yay! How was your appointment? Was it quick?

When my husband filed for his naturalization he did both in 1 USCIS field office, which 4 miles away from our place. So, I'm assuming & hoping it will be the same case for me. But then again, there's another field office 40 miles from us, so who knows?!

According to USCIS: EAD Cat 09 is being processed as of 9/15.

According to VJ: EAD is being processed as of 8/28. I don't think VJ has the stats for Cat 9?

Which one is correct?

I am EAD Cat 9. Does this mean I should get it earlier than what VJ says?

No one really knows as to when they will get their EAD/AP card these days. There are people who filed June, July, or August that have not received their combo cards, but there are September filers who are starting to get their combo cards now. I'm just really hoping we get ours w/in 60-90 days instead of 120+ days. :)
