Can I leave the US after applying for my husband's f2a visa? I was thinking of staying with him in Japan while waiting for the approval. We are Philippine citizens but he resides and works in Japan. Is that going to be problem for us? I am currently unemployed but we already have someone to co-sponsor my petition. I know f2a visas can take more or less 2 years so I am gonna have to acquire a re-entry visa. Another thing is I just came back from the Philippines in August after staying there for 2 years.. can I apply for another re-entry travel document so soon after I got back? Thank you so much

An LPR must maintain the US as their permanent residence. Any travel over 6 months may raise suspicion of abandoning residence, and travel over 12 months has a presumption of abandoning residence.

 

You can look into a re-entry permit (I-131) to permit travel abroad up to 2 years. You will still need to maintain ties to the US, though....i.e. file your taxes,keep bank accounts, etc.

 

How far away are you from applying for citizenship? Through what means and when did you get your green card?

Sorry, I missed this last sentence. Whoops!

 

Yes, you can technically get another re-entry permit. However, no guarantees it will be granted nor that you will be able to enter on it after being abroad for so long with only short stops in the US. It's a hard sell, IMO, but people have been successful with 2 back to back re-entry permits.

Good to know that back to back permits is possible.. Now let's say I was granted a re-entry permit and I do have a bank account and a paid off car under my name.. Can I stay with him while the petition is ongoing? I don't have to constantly correspond with USCIS, do i? We have a USC daughter and we plan to raise her here in the US.. We just don't want to spend so much time apart. Thank you :)

If you get a second re-entry permit and maintain sufficient ties to the US, then it's possible. However, this determination is made at POE, so nobody can say for sure that it will be permitted. Personally it sounds pretty risky to me...although I'm quite risk-adverse.

 

There's no need to communicate with USCIS throughout the process....just to file the forms and do biometrics for the re-entry permit.

The I-130 for your spouse can be filed at any time and from anywhere.

The I-131 for the re-entry permit must be filed within the US (as well as doing the biometrics in the US).

does the I-130 require a biometric appointment for the petitioner? if so, does it come soon after filing or does it take a while for them to request it? i am worried that if I leave after filing I'd have to come back for biometrics..

The I-130 technically can have biometrics or even an interview, but this is very uncommon (to the point where it's barely worth mentioning).

The I-131 will have biometrics.
