I-865 Sponsor's Notice of Change Address

Okay, I'm really confused right now since I got mixed response from different member here. I got my conditional green card when we're still living to our old apartment which we stayed before and after we got married, last quarter of 2015 we decided to move to another city (the same state) so we can be closer to our work place. I did file my AR-11 after we moved to our new apartment and got all the mail correspondents from USCIS after I filed my ROC, but my husband did not file the I-865. Does my USC citizen husband (My sponsor) need to file the I-865 since we moved to another city and have different address now? Does anyone here got their 10 year green card from ROC and moved from one city to another without filing the I-865 of their USC citizen spouse?

Yes, if your husband was your sponsor for AOS than he has to send the sponsor change of address form I-865 in the first month of change of address. If he forgot to send it within a month of address change he should send as soon as possible. I have seen people filling late without any problem. It is a law and required. You can see the instructions here https://www.uscis.gov/i-865

Yes! That's a part of the contract he agreed to when signing I-864 affidavit of support - he must file I-865 within 30 days of moving.

Failure to submit I-865 may result in the sponsor being fined (it's exceedingly rare, though), but has no bearing on removal of conditions.

@Name O Boy is correct. In theory, you had 10 days to file AR-11 and hubby has 30 days to file I-865. Just file it now... it's free (except for the stamp)! About the only part of this process that is!

I think youre confused because when you go to the USCIS website for change of address, it doesn't really mention it for change of address. I must admit I wouldn't have known about it until someone on here pointed it out to me, as I did with you.  I also asked the question again to clarify when I found about it.  I think It's best to cover all bases, its better than it coming back later and biting you in the a"" later down the road.

Yeah that's really makes me confused about it. So my husband already filed out the form and signed as well so we're ready to send it tomorrow morning the form. I think you mentioned as well to me that there is no supporting documents or evidence that I need to attach on the I-865 form right? And USCIS will send me a letter to confirm that they accepted and received the I-865?

Yes for the 1-865 you don't need support documentation, my husband sent it certified return receipt requested, so we got a receipt from the Post Office, followed by a letter from the USCIS.  And you're welcome, you can do the AR11 online if you havent already done so, I couldnt do it so I rang them up and then did a manual AR11.  :)

Got it, thanks again. I did already filed the AR-11 online 2 years ago 10 days after we moved here in our current apartment. So the only missing is the form I-865 that we really dont have an idea about it until I found out in this forum. This forum is really a big help. Thanks again and Good luck to us. :)

 

By the way, took how many days before you got the mail from USCIS after you sent the I-865?

I have the same issue as @Lemon23. My husband hasn't filed the I-865 (because we are not aware about it) and my I-751 is still pending. Is it okay to file it now even if its too late?  And also, where will I get a certified return receipt requested? What supporting docs is needed for I-865?  Do I need to send an extra envelope for them to return the stamped I-865 that they received it?

I don't know the legalities of filing it too late, although I am sure it will be fine.

 

My 1-75i was pending when we submitted the 1-865 , so no worries there 

 

 You can ask for certified post and request a return receipt at your  localPost Office.   

 

You do NOT need documents to support the 1-865, that you send.  You merely fill in the form (very short)  take the form to the  the Post Office to be mailed,  ask it to be sent certified post  and request a receipt upon delivery, 

 

You do not need an extra envelope. What will happen is that once you send the form,  then pay the fee,  you will receive a receipt to say it was delivered, within the matter   of a  few days...  after that you will get a letter from USCIS to say that they  have received your request and have updated their systems to acknowledge your given request. Hope that helps to dis-spell any worries you may have.

This wont be necessary, as @shell20 said, she sent her spouse i-865 while her ROC is still pending so it's safe and okay to send without cover letter.

05/09/19: Received email, passport application has been finished processing with USPS tracking number and expected delivery is on 05/14/2019

05/10/19: Receive email from USPS informed Delivery - Expected Passport delivery is on 05/11/2019

05/11/19: Passport book received thru USPS Priority Mail

05/13/19: Passport card received

05/14/19: Naturalization Certificate back - END OF PASSPORT APPLICATION!

hey @shell20 got question for you please. The return receipt tracking number for the i-865 that we sent last week is now in transit back to us. My question Is, is that an actual return receipt or return receipt with letter from USCIS confirming that they changed my husband's address on their system? Just curious since i don't know what to expect after sending the i-865.

05/12/17: VSC received our package

05/12/17: NOA Date
05/14/17: NOA Arrived in the mail & check cashed

06/22/17: Biometrics Appointment at ASC Manhattan

04/09/18: Online changed to case transferred to local office but no actual letter

06/13/18: Card Being Produced - NO RFE/NO INTERVIEW

06/16/18: Approval Letter arrived in the mail with 06/13/18 approval date

06/18/18: Card was picked up by USPS

06/20/18: Received 10 years Green Card from the mail - END OF I-751 JOURNEY!
