job question concerning affidavit of support

Ok forgive my grammar if it's not perfect. This post might be a bit long but I have some questions that are really worrying me.

I met my fiancee online in early 2010, and for various reasons I didn't get a job until late 2015. I made what might not have been a smart move by quitting that job after working that job 2 months. I quit and went to visit her in her country for one month, and I got back home a few days before the start of February 2016. During that trip me and my now-fiancee got engaged, and I even asked and got her parents' blessings for the engagement. Sort of an old-fashioned "meet them and obtain their blessing for it" thing. They told me they couldnt come to USA for a wedding so they at least wanted to be able to have an engagement party. We couldn't have the engagement party on that trip since there wasn't enough time left on my trip there to have it.

So I got home, and got another job in June 2016. I kept that job until early December 2016, when I made what again I'm thinking was a very boneheaded move. I quit again and went to her country Indonesia for 2 months, and had the engagement party while I was there. I got back home early February 2017. It's now late October and after spending months working for my dad while searching for a cosponsor we so far haven't been able to find a cosponsor but still might find one, and I hope to be getting another job very soon.

My question is, how bad does my job history look? My job working for my dad doesn't pay enough for me to be the sole sponsor for my fiancee on a K1 fiancee visa. I'm thinking at this point that with my work history looking the way it does, getting a cosponsor would be strongly advised.

It's math.  They want to see the previous year's returns and they want to see the current year's cash flow.  If you cannot demonstrate the income, you have to get a co-sponsor.

Or wait to get married and sponsor an immigrant spouse until you can afford to.  There's that option.

You need a cosponsor for fiance visa K1 or for a spousal visa IR1/CR1, so the advice would be basically to wait for either visa. 

 

The fiance visa is pretty expensive because you have to pay, after getting married in the US, for the AOS application. So in addition to finding the cosponsor you need to save money for that, which it is approx 1,500. That is in addition to visa fees, flight, living expenses, etc. Anyway, it is all pretty expensive so you should try to get a job and save as much as you can until you have all the money saved before applying for the K1.

Well we applied and I sent in the I-129F in December 2016 and I believe it was approved. In April of this year the embassy or consulate in Jakarta emailed me and told me we had 4 months to get her medical checkup etc and get an interview scheduled there for my fiancee to do. So the deadline was around mid-August. before the deadline came I emailed the embassy and asked if the 4 month deadline could be extended, and they said "we can always extend it". They never did say if they extended it though. I just (maybe stupidly) assumed that they did, so I'm thinking of emailing them to ask if it was in fact extended, and if so, for how long. I hear some extend it for 4 months. I also hear that some extend it for another year.

My biggest concern though is if my work history appears to be any sort of red flag. I have other questions about cosponsors but I figure I'll probably need to make that into a separate thread so the subjects don't get all mixed up and confused.

I know it can be expensive yes. The expenses won't be a problem when I get another job, which I expect will be very soon. Though I'm also concerned how to explain my reasons for quitting those two jobs I mentioned before. It could make getting another job difficult. I think the way I quit those two times wasn't the smartest move.

They ask for your taxes and then, your current job information for the financial side (with cosponsor if you cannot meet the minimum).

 

There won't be any "explaining" to do. There are people who had been un undergrad and had not worked and got 1 job, and with that they applied for the visa. I don't see a problem really. You quit because you were traveling to see her. Just try to keep your job. You will need to be employed while she is doing the K1, then when she comes to the US, then get married, then AOS which takes months, etc. So you will need to be employed for a long time.

I mean explaining to future employers why I quit those two jobs, and how hard it may be to convince another employer to hire me after the way I quit. Another bad move I made was not even giving notice to either of the two employers when I quit those jobs........

Based on what I know about the Jakarta embassy my guess is that your K1 case is DOA.  The time to pull things together was a year ago.  Didn't realize your case was already at this stage.

They do not care about your work history.  They care about your previous year's taxes W2's plus bank deposits and paystubs all the way up to the interview date for the current year.  

Jakarta is a tough embassy - relatively speaking.  Your lack of attentive follow up on this case I suspect has already flagged you.

So did she do the medical and get the police certificate or not?  If so - it will have to be re-done.

She hasn't done the medical yet because I read elsewhere on this forum that the validity of a K1 visa once it's issued is 6 months from when the medical was done. As far as getting the police certificate, I asked her before but I already forgot what her answer was, I'll ask her the next time I talk to her.

If my application does get denied due to the stuff mentioned above, what would my chances be of applying again and getting approved if I fix whatever went wrong the first time?

If you did and they did what are your plans?  Where will you live and what sort of wedding plans do you have?  Big?  Small?  Who will be the guests?

If I get a cosponsor shortly and get another job shortly then we'll both be living here in USA in an apartment at first. Me and my fiancee agreed to have a smaller wedding with my relatives being the guests since her family can't make it over here to attend.

Good.  That's how her interview will start and they will probe from there.

 

A co-sponsor will kick this off nicely.  Good luck to both of you!
