Filling out Form I-864W (split and merge)

Hello ,

i’m having the same issue with form i-864W. I have 36 credits and my wife about 20. My wife is a US citizen. From what the instructions appear we can combine the credits earned during our marriage. Sent the SSA STATEMENTS FOR MY WIFE AND I as proof , just how the instruction states . I don’t know if they need any other proof beside the ssa statement.  I just recieved an RFE stating that i need to file form i-864 because i don’t have 40 credits. Weird . Now i have to file i-864. Help would really be appriciated .

Most of the credits have been earned before my marriage and small amount during marriage.  I have 36 and my wife has 20 . Literally i just need 4 more. Ssa statement stated that i have enough credits to recieve benefits . This whole thing is kinda confusing .

I’m in the same situation with form i-864 because my family size is 3. And i’m being sponsored by my wife . If i put 1 at married and do the total count at the end it comes up to be 4. So putting ZERO at the question if married is the right option . I’m gonna meet up with an immigration lawyer to make sure the form is filled up right.

If anyone is familiar with form 864w , i would really appriciate some help . I have earned most of my work credits before marriage . I have been married for 2 years. I have 36 credits and my wife has 20. But i can only use the credits during marriage . Filed form 864w with aos . Recieved an RFE stating that i do not meet the 40 credits . I included the ssa statements for my wife and i . What did i do wrong ?

You should make your own thread instead of posting on old ones. This is the second post you made on someone elses thread.

 

You (as the immigrant) can use ALL of your credits youve ever earned. You can only use the part of your wifes credits that were earned during the marriage. It seems USCIS does not think you have enough. You state you have 36, so you are short 4. Your wife wouldve needed to earn at least 4 credits during the marriage. You can earn 4 credits each year. Did she earn credits during the 2 years of marriage? If so how many?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes she earned 4 credits in 2016 . With her 4 credits earn during marriage , it rounds up to 40 credits. I basically qualify to file 864w .

If you are confident about what you are posting then an option is to submit it as a response to the RFE. Might I ask how you accumulated 36 credits? Thats a lot and would take several years to do ! Are you or have you been on a work visa for 8 or 9 years?

 

Anyway, if your statement says you have 36 hours and her statement shows 4 credits for each year you were married- you can highlight it all and send it back as the answer to the RFE along with a written statement explaining what you highlighted. The people at USCIS are in fact people and can make mistakes. Not many people qualify to use the 864w so its not surprising if it was rejected improperly.

Yes i have been working for about 9 years .  I called the SSA and i also went in person to SSA , i was told i have 36 credits and my wife 20 credits . Anyways i do believe there’s a mistake somewhere. I did what the instructions on the form ask . I sent the ssa statement for me and my wife . I tried earlier to attach a picture of the RFE , i couldn’t . Thank you for your time and help .
