technically you don't have to have it in hand but it has to be approved before you leave. to attend a board meeting is not a really good reason since you will need to show that it was not a scheduled event that you are forcing them to give you emergency ap for and that if it is just a meeting why you can not just call in or do a video call.

 

if you do not get ap they will not let you back in without an immigrant visa since you have clearly established immigrant intent. you are looking at 12-14 months outside the us if you leave. emergency ap is usually for unforseen medical or death of close family members. not business or vacation travel.

Thank you , my lawyer said the fast interview she can try to get for my k3 VISA is 6 months,  I hope some people had that experience of getting k3 visa interview within 6 months.

As we said previously THERE IS NO K3 ANYMORE maybe 300 of those are given out a year if that at least count. Usually when you file it will revert to a CR1 visa and the timeframe is 12-14 months.

Your lawyer was wrong...in July, it was still taking over 3 months on average. Not sure why they were positive it would take less than the average...?

They have never questioned (or reviewed) the validity of the marriage.  You haven't gotten that far into the process yet.

Your lawyer is very wrong (again). K-3 is obsolete...I'm surprised they would even suggest it. Well, not too surprised...it's more forms to fill out so they can justify a bigger bill. ;)

Even if the K-3 were somehow to go through, you're looking at probably around 8-10 months...no way within 6 months since the I-129F alone is taking nearly that long.

I'm assuming he came on another visa (presumably the B1/B2 since it wasn't cancelled as is pretty standard when they issue a K-1 or immigrant visa). And he's been married for 7 years, so a K-1 would be a bigger issue. :P

Are you going to elaborate and educate us all or just make a quip? Have you been through the K3 process? Know anyone who has recently? Or just have faith that it is possible?

Sincere question: are you prepared to not be able to re-enter the USA for several (or more) months while waiting to get your visa? I would strongly encourage you to do so if you decide to go to the UK for your meeting.

Op:  You are in a difficult situation, but I have to agree, the K3 is obsolete and in the last 6 years or so, I have seen only 2 surviving NVC stage.  Don;t waste time and money on this path, and seriously re-consider your lawyer if she doesn't know that.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I don't think I have other choice, I have to leave by 25th Oct, so God bless me If I can get it by 25th Oct, and since I have filed the immigration paper, I won't be able to apply for visitor visa anymore, and I need a visa to be able re-enter the United Sates, the K3 is the only option, even it will be converted to CR1 visa, I think my lawyer is aware of that, I have set up an office in US for my business, I need to come back to continue the process and be able to run my business legally, I respect the system, it is what it is, no other way around. The sad thing is I would be able to create jobs here instead of taking job from local people, I would really hope US immigration system can look into the situation and speed up my AP, I appreciate everybody here is trying to help, but again I have to go, I need to come back even I have to get another visa.

You may still be able to use the visitor visa, especially as you field for the CR-1, not tried to do adjustment of status.  Here is hoping!

Based on what I read she did file for AOS - thus the expedited AP request. 

 

She'll probably be back but not in the next 12-14 months.
