First of all, sorry if this is the wrong section on the forums, I couldn't find one more appropriate?)

 

Hey guys!

 

A bit of backstory/history:

I'm in the US on a K-1 visa, I've filed for AoS and EAD at the same time. About a week after I received my hardcopy NOA1 for both cases I called them up to request expedited processing of my EAD.

They took down my details and told me I'd hear back within 5 days (I assumed working days not just *days*, this proved correct). On a whim I checked MyUSCIS online and saw that the expedite request was "Completed" and that they'd mailed something to me.

 

I received a letter in the mail a few days letter stating

Quote

"Our records indicate that we are awaiting your  appearance for biometric processing. Your case is currently in suspense or on hold until we receive your biometrics".

Fair enough, they need the biometrics before looking at the request. Three days later was my scheduled biometrics appointment (this was 2 days ago now). Called them up today and was informed that they'll pick my expedite

request up right where they left off "as soon as they receive my biometrics". I was also told there was no timeframe for expedite requests whatsoever.

 

So my question:

In every post I see about expedites, people talk about their local congressman/congresswoman. Is it necessary to involve them? Does it speed things up or what's the purpose? 

I know who my local person is and can fire off an email straight away if it might help my case. I'm just not sure of the process there. Any help on getting this expedite done ASAP? :)

They probably haven't updated it in their system yet.

Correct...there is no timeframe for expedites. They try to get through them as soon as possible, but there's no guarantees.

You can, but they cannot make the case go faster...only request the expedite. This is typically to find out what's going on and try to exert some pressure for delays. You already have a pending expedite in queue to be reviewed and it's only been possible for them to work on it for 2 business days so far.

 

Anyway, you can ask for their help and it won't hurt your case. I don't think it would help here either, but that's just my $0.02.

hi @Skatie2k17 - i'm thinking of possibly trying to get my ead expedited too. what basis did you use for the expedite and what proof did you have to send them apart from the offer letter? were the people you spoke to when requesting for the expedite nice and helpful?

I asked the lady that took my biometrics how long it would take to get into "the system", she gave me a surprised look and told me it was already there, it's all in the system now

Good to know that congressman/woman isn't required. I guess I'll just hang tight!

"Severe financial loss to company or person".

I worked as a Senior Software Engineer in the UK and they desperately need me to resume working (for their subsidiary in the US performing the same duties) ASAP or they'll suffer quite badly. 

The person that took my request just asked me to explain the basis of my request, they asked for no evidence what so ever (which to me at least was very surprising...). I do have a signed contract already, letter from the CEO, etc. But no one has asked to see any of it yet.

 

I've had to call the USCIS a couple of times over the past year, I'm not sure I'd classify any of their customer service representatives as "nice". But they seemed to get the job done with my expedite request (I guess?), so I guess you could say they're helpful. Good luck with your request should you decide to pursue it!

thanks for the inputs! very helpful should i decide to go ahead. i am still enjoying the break from work but who knows i might get lucky and get a job offer soon.

I just received NOA1, I have a job offer and meant to start 22 January. My question is can I expedite 

now or should I wait for biometrics invite letter? I cannot figure out what the best route is?

I'd advice against requesting an expedite before having your biometrics taken (and possibly even wait a day or two after).

I've been on the phone with USCIS and was told that they simply can't do anything with an application before they've received the biometrics. 

I requested my expedite before having the biometrics appointment, and I got a letter in the mail saying that my expedite request will be "On hold" until they receive my biometrics.

I don't really believe that it was "on hold" as nothing at all happened with it in several weeks. I had to request expedite again(!) for it to start moving.

Thank you so much! I've just received the biometrics appointment so I will be doing that today and waiting for a few days before requesting expedite. Did you fax your request? Any tips on what needs to be added in the job offer letter?

Oops, sorry did not see this! Been a busy Christmas :D

I called to request the expedite, I then received a request to fax in the job offer.

 

Not sure what's needed in the offer letter, mine just said there was a position earmarked for me, and outlined the conditions of my employment (hours, salary, location, etc..).

Wow, your case worked out like a dream!

 

I faxed my job offer on Jan 10. No updates until today from my congressman: This case will be routed for expedited processing.  Your constituent will receive a decision or notice of further action shortly.

 

Based on your experience, does this mean my expedition request has been approved? Thanks!!
