Hi all, 

 

My boyfriend (Matthew) and I are trying to complete the I-129 form... And we have a couple of questions ... more like: we are wondering what to do. How many of you think that we should get a lawyer involved in helping with the process?

We have been together since 2015 and have been visiting each other constantly. I live in Bulgaria and he is in Maryland. I am contracted through a Bulgarian company and work for companies in The Staes  and have been traveling for trainings a lot.. until one of the companies there decided that applying for J1 visa and get me there as a trainee (not intern) is a good idea... So I went on my interview here (in Bulgaria) and got denied... Got the regular letter, saying I cannot proof I will return to Bulgaria - the CO though I am going there as an intern and have a 7 year background in this niche ... so I think this is why I got the denial. Refusing my J1 also caused cancelling my 10 year B1 visa... 

Then, I got selected for H1B visa, but the application got withdrawn. The lawyer sent two petitions...   because she never got a receipt on the 1st one... 

So my question is: based on the written above... do you think we might get denied the K1 visa?? We just got comfortable with all of the trips and was convenient for us, but now we just want to be together all the time... Matt is willing to move here if we get a denial, so I am not that scared... any advise will be appreciated. Thank you!!

In general, other visa refusals do not affect the K1 visa

 

In this case in particular, I would not think that it would. You were filing the J1 and the H1B at your company's request right? Not because you were trying to do something malicious to spend more time with your fiance? 

 

I think that you can easily show a path of how you have been working for them - if they are willing to write a statement or if you have proof of these job offers (which would show why you applied for these visas) then it would be favorable for you as well. 

 

But no in general it does not affect. Good luck!

Thank you!! Yes, the company I am still working for, form here, applied for both. Do you think that, in general, is good to get a lawyer involved, to just review the app and give us advises?? Not sure how this actually helps. The petition looks pretty straight forward and we have a lot of proof for our relationship.. Also, if I need to provide addition information on the H1B and the J1 visa will be at the time of the actual interview, right? Not now?

In general, MOST people on VJ do not get lawyers. If you are concerned about whether or not you forgot something, you are welcome to post something on here like your table of contents or your cover letter (minus names/identifying details) and many of us who have been through this would be glad to review it. 

 

Of course hiring a lawyer is completely your call, but its certainly not necessary - the guides and the people on here are generally very willing to help you anytime. A lawyer doesnt do anything but put your papers in an envelope and write a letter for you - you would still have to submit to her/him all your relevant paperwork. It sounds like you two have been together a long time with many visits so I would not concern yourself too much.

Quick questions. Do you think this is OK for Proof of how we met in person, or we need more info, Also we have listed we use Facebook to chat, but we are not enclosing any chat records?

How we met:

 

            I met Liliya Nikolova on 11/05/2014 when she was in Frederick, MD training.

We started hanging out as friends for a few months and officially started our relationship on 07/12/2015. We continued our relationship to this day. During our relationship we have taken several trips. On 04/22/2016 Liliya and I took a trip to Disney World with my family. I also visited her while she was in Terrell, TX training on 01/25/2017. On 02/23/2017 I took my first trip to visit Liliya in Bulgaria and stayed until 03/12/2017. At the beginning of March 2017 we went to Italy with her friends: Diyana and Tihomir. I returned back to Bulgaria on 05/25/2017 and stayed until 07/31/2017, we visited Rome and Greece during this stay. I am visiting my fiancé again on 12/08/2017 and will be staying until 01/21/2018. During this period we will be in Italy and France (12/21 – 12/29).

We use Facebook to keep in touch and we talk, chat constantly while not together.

I think that looks really great. It's recommended that you send a small amount of chats - some people send hundreds of pages which would obviously be way too much, but a few screenshots of conversations printed on a page for each month or two I think would be appropriate. If you stayed in hotels/Airbnbs on your vacations I would include those receipts as well.
