So, my fiancee and I are July filers so we're still waiting to hear back. We have plenty of proof of relationship, a lot of which I submitted with the original application. Early in our relationship she tried twice to get a tourist visa to come visit me in the States but was denied both times, we think because she didn't have a job and couldn't establish strong enough ties to home to convince them she'd return at the end of her trip. Anyways, that was last year and this year we got engaged and filed the I-129f. I was wondering if you guys thought her previous tourist visa denials would complicate the I-129f approval process or the interview process. Thanks!

Nah.  Completely different process.  My guess is my future wife would be turned down for a tourist visa but will get the K-1 without a problem.  

 

With the tourist visa they really only care about your ties to your country.  If the ties are not strong enough they will deny the visitor's visa due to the fact they don't believe there is a compelling enough reason to return.  

 

I had petitioned another friend a few years ago.  She had a house and a job and a son who was not traveling with her.  She was denied because they didn't feel she had compelling enough reason to return to the Philippines.

 

I do not believe the denied visitor visas will impact you at all as long as you meet the requirements of the K-1.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

There's many reasons to be refused for a tourist visa that also apply to the K-1. At the same time, they're (usually) pretty obvious ones - criminal history, security checks, misrepresentation, past deportation or unlawful presence bar, etc. By far, the most common reason for refusal of a tourist visa is immigrant intent (214b), which isn't an issue for a K-1 since it allows immigrant intent.

 

I wouldn't be worried about the refusals being an issue for the K-1. It just needs to be disclosed when asked about it on the DS-160 or in the interview.

Yes!  I really don't think they need to be too concerned as long as they are honest and open.  I think the mantra here is to always be honest and answer the questions but do not offer any additional information.

@Geo_nerd82 agree 100% with the answers above, you will be fine as long as you and the beneficiary are completely honest and have all the docs to provide.

8/16/17 --- AOS Packet received Chicago USCIS Day 0

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
