There usually are not too many denials on a K-1 if all the requirements are met. Probably the biggest problem would be failure to prove a relationship.

Whan I was talking about requirements I was meaning that I am assuming that the couple have sufficient income or a co-sponsor and have met in the last two years, and don't intend fraud.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.
Waiting - Waiting - Waiting
3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

hmmm....well...usualy if the relationship never existed...and u just want to do it for papers( no evidence and other things), if your fiance has some dangerous desease they might deny at interwiew, some bad criminal records( not sure about this) blah blah... if u guys have all evidences and everything good dont worry about a denial..it happends not very often... :thumbs:

i found this on a website...possible problems:

1. Missing documents

2. Incorrect paperwork

3. Insufficient income/savings of the U.S. citizen sponsor

4. Very large age difference between the couple

5. Fiancee can not obtain written consent from the ex-husband for their child to leave the country

6. Poor English skills of fiancee

7. Couple hasn’t spent enough time together in person

8. Couple lacks sufficient evidence of recent day-to-day contact

9. Fiancee interviews poorly and the consul doubts that there is a bona fide relationship with the U.S. citizen

10. Fiancee has relatives or friends in the U.S. who seem to be taking too large a role in match-making

11. Fiancee was previously in the U.S. and overstayed the visa

12. The U.S. citizen has previously sponsored a foreign national for a green card and the U.S. citizen can not prove that the foreign citizen maintained lawful status

13. Fiancee has a criminal record

14. Fiancee has a serious, contagious illness (such as AIDS, tuberculosis, etc.)

15. Fiancee commits a misrepresentation during the interview (or so it seems to the interviewing officer)

16. Petition includes a document that is deemed to be fraudulent

Timeline

A petition can be denied if you haven't met in the previous two years or if the petitioner is not a USC. Other than that, it's all about paperwork and evidence.

At the interview, as stated, there are many reasons for visa ineligibilities. Some can be overcome with a waiver. See Classes of Aliens Ineligible to Receive Visas

Actually Dora-David a couple of the points you found are not grounds for denial. The large age difference one and poor English skills are not grounds for denial. They may cause them to look harder at the applicants to make sure a real relationship exists. For example on the English skills, they may question the couples ability to communicate. All in all they are not supposed to pass judgement on the suitablity of the couple but only to look at the motives and make sure there is no fraud.

I would also question #'s 8 and 10, the day to day contact and relatives. They may be grounds to probe deeper but can not cause a denial in and of themselves. Otherwise it was a pretty good list and interesting.

The only one that bothers me is #7. I've only had 2 one week visits. one in september and one a couple of weeks ago. other than that, our case is flawless. any comments?

I'd like to say my fiance and I met through his mom. She was not setting us up or playing match making. We were the ones who decided that. Anyhow, our interview is July 9th, we'll keep you all posted on how it goes. We know that there will be a red flag once my fiance mentions how we met, but we have plenty of proof that our relationship is real. But we'll see how true statement 10 is on your list.

I am alittle worried becasue we tried for a B2 tourist visa in 2/07. We put off our engagement because she wanted to see USA before she left all behind. I told her to check no for "fiance in usa" becasue we were not technically engaged. She was denied tourist visa. We decided to go ahead with 129f so i sent the visa application with january dates(when i visited her in jan we filled out 129f). I hope the embassy doesnt think she lied. I emailed the moscow embassy explaining myself and they suggested i send a "letter of explanantion" with my fiance to interview.

To be honest, I am just plain tired of all this visa ****. All the worrying. Does anyone know why it takes 100 days to approve a 3 page petiton and to look at some pictures and emais. I could do 100 k-1's a day!! It is sooooooooo stupid. Hey USCIS, dont send my K-1 from Texas to California where they are already jammed up. Send it to Vermont where they are counting ceiling tiles. IDIOTS!!!

Anyway, I feel better now!! I am prepared to move to Russia if necessary so I dont worry anymore. Fortunately I can work for 6 weeks in the USA and live for a year in Russia. I kind of like the thought of living in Vladimir, Russia! It is a beautiful and crime free little city!!! Its awesome!!

APPROVED MAY 22 (On 5/25 I did the RFE trick and the CSC said it was approved 5/22. The dufus at USCIS was completely positive they were only working on Nov. 2006 petitions)

May 30th- Petition leaves CSC for NVC.

3rd visit - May 31 - August 31 ( If all goes well she will come home with me!!!)

Left NVC June 11th (I called everyday since 5/30 and they never recieved it??? Then on 6/13 I called and it was not only recieved but already sent to the embassy 6/11?? 

INTERVIEW 8/22

July 3rd-Recieved Packet

8/22 Interview was a sucess!!!

8/31 We arrive at JFK. Problem free entry.

10/26 Married!

1/15/08 Sent I-485

2/26 NOA

3/21 Biometrics Appointment

3/29 Received EAD Card

Russia is alot cheaper then Germany my friend. My girl pays about 150 bucks for a nice 1 bedroom apartment. Food is pretty cheap as well as everything else. I would prefer her to come to me but I am not going to worry anymore. If for some reason they say no I will sell all my stuff, buy a beater of a car and leave it at my moms. Come back for a month if i need money. Once I learn Russian I wont have to do it but it is a nice fall back for some quick $$$.

No country, no service center, no embassy, no consul (with a god-like complex) will stop me from being with my Irina!!!!!!!! I will be with my Russian Queen May 31 to Aug 31!! Hopefully I will be there for the interview!! It will be close!! Might skip to Ukraine to get a 1 month visa if necessary!!!

I wonder if i can get a job at the CSC and approve my own K-1??? They would probably fire me because I am too quick and efficient.
