The form asks for years included with the application, spouses inforamtion and signature. The first two years were filed with my ex-wife and last years with my wife. Do I have to include a two copies of this authorization, one with my ex's signature?

Joel,

Since the income figures of the first two years of your tax returns are not figured into the I-864 it seems likely that a signature from your ex is not required. Only the most recent tax return should be considered when completing the Authorisation Release form and so you and your current wife should sign it (Just that one).

You can confirm this by dropping an email to the NVC (nvcinquiry@state.gov)

Let us know what you find out.

Actually, the instructions say 3 years worth of tax information. Someone on another group said just have my current wife sign one form for all 3 years. I will take that advice and see what happens. I can't imagine they would make me look up my ex-wife and have her sign forms.

Thanks,

Joel

Joel,

The issue of whether 1 or 3 years are required is a little unclear at present. There has been new I-864 guidelines released which are only requiring 1 years return with the I-864 at interview for an immigrant visa, inline with the policy/guidelines released 2005 for Adjustment of Status. There has been posts trickling in of some Consulates requiring only the most recent (1 year) tax return for interview. All we can be guided on right now is the instructions each of us receives from the NVC or Consulate.

You can view the newly released guidelines HERE

Joel,

Yes and I am not disputing that.

But the greatest emphasis for determining sponsor eligiblity is placed on the most recent year by the CO.

Read part 4C of the I-864.
