what and how to file a petition for my adopted child that i didn't declare when i got  my parent petition here in Us..i was not undergo in legal adoption process because i dont have a money but in my child birthcertificate im the mother...need help and advice

Your options may be limited. How old is the child? How long ago did adoption take place?

 If you didn't declare the child and now petition and claim the child is yours they will want DNA and that won't work.  IF the child is over 16 it is too late to get a legal adoption for immigration to use.  Where has the child been while you came here ? 

This will not be over quickly. You will not enjoy this.

His 9yrs old now...i take care my adopted child since he was born. He was 5yrs old when my petition granted. And since then my aunty and uncle take care of him.monthly i send a money for his school and everyday living and almost every we talk.

Was it an official adoption? Meaning you have legal documents from the adoption?

You didn't adopt the child, and it's not yours, but you're the mother in the BC? How?

If you're not the biological parent and it was not a legal adoption, then there's no basis for a family-based visa.

 

If the adoption was somehow legal, then the issue is why wasn't the child listed on the original petition? It sounds like you want it both ways...not having the child recognized originally, but having him/her recognized now.

 

Legal adoption permitting immigration benefits may or may not be possible still (depending on local laws and the status of the biological parents), but that's probably best handled through a good attorney experienced in those matters and the child's country.

since the child was born before the petition was filed the child will need it's own petition. but that is secondary to even adopting the child or determining if the adoption is even valid for immigration.

 

it is possible to legally adopt the child but for the adoption to not be valid for immigration. the main issue is are the child's biological parents alive.

 

these restrictions are in place to prevent family members from adopting relatives so the child can move to the us.
