There's something you could try that I bet would work.   Walk into your U.S. Congressman's Office without an appointment.   Ask if you could have a few moments with someone who works for the Congressman, an assistant maybe.  Have all your paperwork ready with a letter to the Congressman already typed and signed.  Tell them your delay and that you're frustrated that your $500 + was cashed quickly and you've heard nothing.   They will help you!  I did it once and it worked!  They will send a Congressional inquiry to USCIS which gets priority attention!

They won't help you until you're outside the processing time listed on USCIS's website. Or, rather, USCIS won't take the inquiry from your Congressman until you're outside the timeframe on USCIS's website. Not only did I have that job before, so been there done that, but I was an applicant during a time where TSC was averaging 7 months wait time (and CSC was averaging 3 weeks). Nothing anyone could do. Don't waste your time, or if you insist on trying, email/call before going into the office. But they'll tell you the same thing.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

It is literally not up to each member, it is USCIS's policy, or at least has been for many years. They, USCIS, even the special-Congressional-service-only phone number people/managers, will not open a case until the applicant is outside the posted processing times. This is why they fudge the dates on the posted processing times. If you applied a long time ago, things may well have been different then. If more recently, what may have happened is that you were outside the normal processing times and they were able to help.  Or, you weren't but they took your information anyway, to humor you (this is common) and the application came through on its own shortly after and it just looks like they worked magic for you. They didn't. They do know how to make themselves look good though, especially when most people don't know how it works behind the scenes.

I'd recommend waiting until you exceed 180 days and filing an inquiry directly or through an elected official once you have exceeded the norms, as others have said, you have already invested a not-insubstantial sum on the K1, it's lost money otherwise to forego the K1 and proceed with the CR1, plus getting the certified marriage extract from the Philippines is not an immediate thing and then you are adding the overhead of 2 government beaurocracys to get to your desired goal.

12-14 months for cr1 that is still an estimate. My friends wife just got here from the Philippines and there CR1 took closer to 2 years. I'll stick with the K-1 and just keep praying.

You're in a hole waiting on the NOA2, it is inevitable that you WILL receive an answer.  Take these peoples advice, or disregard it - it's your choice and your journey to guide, but consider today's news in the March filers - @FutureMrsBennett got her NOA2, and they persevered more than most of us could imagine that we could have.  She had many down days, frustration, aggravation, etc. etc. but today, she is further ahead than if she would have thrown in the towel.

VJ is a great community for support and clarification.  In these 3 pages - I'm pretty impressed with the people we all rub elbows with.......  You're in good hands here.  Hang on - you WILL get there :D 

I am trying but dam it is hard and very trying on the nerves, this is very frustrating to say the least i have 2 more weeks accordingly for 6 months i am at 166 as of today. I was planning on traveling over there again to be with her for all but have to hold on now cause i can not afford to do it twice back to back, been a year since i held her in my arms but do video chat when we can but not the same as holding in person.

I'm a CR1 filer, I've been waiting 8 and a half months now. A lot of people have been waiting for 10-11 months, no NOA2. So we are looking into a 14-18 month process. 

You're so close to your NOA2, why lose the money and time already spent and file for a visa that in some instances can take three times more, when the reasons for withdrawal is that you miss your spouse?

➺ 02/08/17 Case Assigned to USCIS Nebraska, sigh. 

➺ 02/13/17 We got our NOA1! PD: February 8th 

➺ 12/15/17 NOA2 finally! after 10 1/2 months. 

➺ 12/21/17 NVC confirmed they received our file 

➺ 01/22/18 Documents sent to Rapidvisa 

➺ 02/05/18  NVC received our package 

03/15/18 Case complete! 

06/27/18  We got our Interview date! August 28th 

08/30/18 The package arrived (waited at Juarez)

08/31/18 Entered the U.S with my husband 

➺ 02/13/19 Husband confesses he cheated, leaves

➺ 02/16/19 Husband decides to abandon the marriage

➺ 05/13/19  I am officially divorced. 

 ➺ 07/03/20  I file to remove conditions on my own     

 ➺ 08/13/21 I finally get my biometrics appointment 

➺ 02/26/22 I got my interview assigned: March 31st.

When we filed "the normal" was 2-3 months, that just made it even worse having to wait for 6. We still don't know what the hold-up was about.

Yeah, the majority of people have to wait around 5-6 months as it seems.
For us it went super well. We had NOA1 notice date on March 22nd 2017, and my interview was on August 8th. Visa in hand on the 12th. So it took us barely 5 months.
OTHERS of my march group had to wait soooo much longer. Just saw someone got NOA2 now after 7 months.

So OP.... stick to your K1. You've waited so long, don't throw all that money in the trash. Once the NOA2 is there, things are speeding up!

What gets me is that USCIS doesn't give a rats backside if they're 90 - 180 - 360 days processing a NOA2.  They could care less.  Doesn't change their life any but it gives them power in my opinion making people wait.  I personally think they're understaffed right now or they're focused on a different Visa type that has taken priority.  Combination of a lot of things I'm sure.
