Hello guys,

I have concern here about my k1 visa . I'm already here in he US and the immigration giving me a 90 days to get married here and my fiance decided to marry me on the 90th day?im kinda worried about this i dont know if this okay to get married on the 90th day. Please answer my question. Thank you

  Don't forget that the day you arrived is included in the count  so it is really 89 days after you arrived.  After that you have to file an I130 

This will not be over quickly. You will not enjoy this.

Sometimes you dont get your marriage license right away, it takes a couple days to process, so I would try to get married before the 90th day - at least like the 85th. Why do you need to wait till the 90th? If something happens it could be risky.

Waiting until the last day to marry is very risky.  You never know what kind of circumstances could arise, so I would not recommend doing this. I'd give myself more time than  that. Unless you want to possibly risk not being to AOS from the k1 and filing an I-130 instead. Which means lots of more fees and waiting times.

I agree with the above replies. Have you guys already got the marriage license ? you have 90 days and yes the 90th day also comes in count for marriage but why risk on the 90th day ???

Very risky.

 

My wife and I did a courthouse marriage and it took a few days before we could get the marriage license. Plan accordingly!

Why the need to wait 90 days? Anything could happen on that day...then the process gets more complicated and more expensive.

Do not wait until the 90th day!  By the time things get processed it will already be invalid!  I would suggest 10 days for the paperwork.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Your fiancé decided to marry you?  Don’t you have a say?  I would not wait until the 90th day.  Way too close for comfort!

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

You actually need to check your passport. Because my wife came in and we actually lost a day or two because of the stamp. Not sure how it happened, but it did. Make sure the wedding is before the date in the passport.

Definitely not a good idea to wait till last day because you made a statement to marry within 90 days after entering US and you won’t be able to get a marriage license which is a proof of this.

 

 I just wonder why your fiancé decided to do this on the last day? Any important reason behind such a decision? For me it’s unusual... and definitely not responsible after whole time consuming and complicated K-1 process :/

Out of interest, since I never thought about it:
What would happen if you get married within these 90 days but file AOS after the deadline stamped in the passport?
Would the spouse have to leave the country again and file for CR-1?

I'm glad we got our stuff fixed, so we'll be good on time. It's day 26 after POE today, and we'll have our wedding next week. So plenty of time left for filing AOS, since my admission stamp is valid until December.

Nope. They can file AOS based on a K-1 after the 90 days fine so long as they married within the 90 day period. The unlawful presence will be ignored for AOS purposes.

Ahhhhh I see! Then I understood wrong above. Because I thought it might be like you said.
But I've read about more hassle and more waiting time and costs, so I was wondering where that comes from if you file after.

Wouldn't their marriage be accepted if it's on last day? Even if you get the marriage cert later, it would still tell the correct date?

I wouldn't do that either though..., wouldn't want to risk it. What if anyone gets sick or something goes wrong. Wondering why OP's fiancé wants exactly the last day of the visa validity. I myself would be suspicious because of that!
