Okay I am freaking out a bit which is not unusual for me!! I am leaving 20 May for my wedding in Morocco which takes time to fully complete. I have heard from several women whom I know from online that they have filed the I-130 in Casablanca before leaving Morocco. Can this be done if I cannot wait long enough to travel back to the US with him and how is it done if possible??

I am more than a bit lost today and would much rather be able to file in Casablanca before I leave. I will be there just over 5 weeks and the marriage will take approximately 17 days to complete.

Anyone with any help at all would be greatly appreciated!!!

If your filing for the K3 you can file from overseas. I was residing with my fiance in the middle east and we filed our K1 paperwork from overseas with no problem.

Thank you so much for a speedy reply! Okay, so how long before I leave Morocco should I file the paperwork with Casablanca? Seems to me that women have had less wait time doing this as Casablanca automatically receives all of the marriage information directly from the Moroccan court. Also do I go and file this in person with him or send it through the mail while there?

I'm not familier with how that works. You should check in the MENA forums. You probably would be able to get much more helpful information. Many of the people in MENA forums have spouses or fiances from Morocco and are much more knowledgable with how the visa processing works in Morocco. :thumbs:

Since the US Citizen is not currently a resident of Morocco, a Direct Consular Filing is not available. Your first order of business is to file the I-130 with the appropriate USCIS Service Center in the US, based on your State of residence. Theoretically, this can be done while you are still in Morroco but there are some logistical concerns.

Unless you live where you can file with the Vermont Service Center, you will be sending the I-130 and supporting documentation to a Post Office Box. This leaves out the possibility of using DHL etc. You'll need to use a service that ends up being delivered by the US Postal Service. Your address of record still needs to be in the US, so they can send the NOA1 to you. If you will still be in Morroco when the NOA1 arrives at your home address in the USA, you'll either have to wait until you get home to file the I-129F for the K3 or have somebody fax it to you in Morroco.

Facts are cheap...knowing how to use them is precious...

Good luck. Read a lot here. Casablanca can be a tough post to interview at for a K3/CR1 visa. You may need to learn more than the average VJer.

Thank you and I know a whole lot more than the average VJer. This was the last place I decided to come to after multiple calls to USCIS and the State Department, reading all immigration law and forms, speaking to hundreds of people and also having my own Moroccan Visa group. I simply could never get an answer from Casa as to filing from there. I would also like to be able to ask questions that pop up from a wider group of folks and assist others wherever I can.

I encourage all US citizens abroad to go to their Consulate and ASK just in case they can get an exception, but the rules regarding filing I-130 abroad were clarified in March:

U.S. citizens, including members of the armed forces, who live abroad, may resume filing Form I-130, Petition for Alien Relative, with an American embassy or consulate in countries where there is no U.S. Citizenship and Immigration Services (USCIS) international office.

Please don't tell me that all of this drama is going to come up again. Why can't people just 'get' that there is more than one way to get a visa or to get thru the immigration process and leave each to peacefully 'do it' their own way?

I had a friend apply for her I 130 before her husband left.. and her papers were ALOT faster.. I gotta admit I didnt really read what the other people posted.. But if you CAN do it.. Why not.. you will be a step ahead in my opinion
