My husband is eligible to file on October 30th 2017 based on Marriage.

This is 90 Days prior to his 3 year anniversary as a greencard holder.

He arrived in January 2015.

We filed 2015 taxes and 2016 taxes but obviously have not yet filed 2017 taxes. Clearly he has filed tax every year he was required to do so.

What should we send when we file? My fear is having the application rejected due to not having all three years and then being out the application fee but I don't want to have to wait three extra months until after we file 2017 taxes before we file the N400.

Please if you have experienced this, let me know how it was handled. Do they ask for tax return later? Do they just reject the application? Do they require some special explanation of why you don't have three years?

Also, he has not yet received his 10 year greencard. We are November ROC filers. Will this be an issue? I would like to hear from anyone who has filed the N400 prior to being approved for ROC.

File now and do 2017 taxes ASAP

the process is taking longer than normal / our friend waited 10 months for interview

so, when interview  comes you will have the 2107 tax transcripts / also you can put in 2014 to show your income that year (u must have had it for the visa)
