Advice: I-751 received Oct 6 but check not cashed yet and drivers license will expire

Hi All,

My husband's 2 year conditional GC is set to expire on October 27 and therefore his driver's license will also expire on October 27. Due to our family moving to a new state, we could not file my husband's ROC I-751 until this month. We have a signature confirmation from USPS that the I-751 package arrived at the VSC on October 6. The check has not been cashed, and we have not received an NOA. It appears that other folks mailing their I-751s in Sept and Oct have had their checks cashed within a week of receipt of the package and received their NOAs shortly thereafter. My understanding from other threads is that we cannot contact USCIS to inquire for at least 30 days from the signature confirmation date. Does anyone have advice what we should do regarding my husband's driver's license and/or contacting USCIS if the check is not cashed this week? We will need to update our driver's licenses at the new state's DMV by October 30.

For now, it's really just a waiting game. You have 10 days until your husband's GC will expire. Wait and see how it goes. You've done your part through filing the I-751, it's out of your control right now. It will be an inconvenience to have the driver's license expired but you can always renew when the extension letter arrives.

Yes - depending on the state, as long as his green card is valid, he might be able to get a full term driver's license. It's worth a shot!

We are now in Maryland. We haven't yet gone to the MVA to ask and were unable to find anything relevant on the Maryland MVA website.

Scanning a few threads here on VJ suggests that Maryland is pretty tough and probably won't give your husband a license without a valid document. So you have no option but to wait for your NOA (extension letter). They may even give you a hard time about allowing the letter, but you'll just have to be patient and explain it to them - speak to a manager if you don't get the response you need.

Ultimately they should give him a license good until the extension expires, and if things keep going as slowly as they are, you'll wind up having to go through all this again with an I-551 stamp next year. Oh joy....

Thank you so much nightingalejules for scanning the posts on our behalf. We have some really good news to share - - we went to the MVA today to ask directly and learned that we could proceed with applying as the green gard had not yet expired. Even better, my husband was granted a driver's license with an 8 year expiration which is the same period of time as the one I received! As you and SM & EF noted, it varies by state. The state we came from, GA, would not have allowed my husband to renew once the green card with conditions expired. I am soooooo glad we decided to go to the MVA and ask 😊
