Hi, I came to the US on a K1 visa, me and my husband were not in good terms but we kept trying to work things out, lately I caught him cheating and left the house, and decided to file for divorce cuz this marriage is not going to last longer than that, I put so much effort to stay together but he hurt me and can't go back to him again. Do I have to leave the US after we get divorced? How does that affect my immigration status. Thank you in advance

Ps: I have a permanent green card

If you have a 10 year green card then there is really nothing to worry about

09.2015 - Green Card received.

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Well you said "pernament". 2 year green card is "conditional". As long as you have proofs of entering the marriage with good intentions you can file for 10 year green card with a divorce waiver.

Agreed,

  • Finalize divorce
  • Gather all evidence of bonafide marriage and divorce decree
  • When it is time, file for ROC with divorce waiver

You will be fine.
