I went to the social security office today trying to get my name changed to married name, but couldnt get it done, since my I-94 expires today, and they told me to come back after I have my final immigration paper, which is the green card....I have heard people getting a corrected SS card when they get their EAD, how did they do that? Have they already have their AOS approved and received their green cards before then? We havent sent in AOS application, still waiting for the 2005 tax returns. Will I stop being out of status once we send in the application? or am I out of status until the AOS is approved?

Thanks, any advice/help is appreciated!

I have heard people getting a corrected SS card when they get their EAD, how did they do that? Have they already have their AOS approved and received their green cards before then?

You can get the name changed on the SSN card with either EAD or the green card. Both are accepted by SSA for a name change.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

I went to get my SSN changed over to my married name last week.

I had to show them my EAD card, passport and marriage cert.

So you will have to wait to change it until you have your EAD card or Green Card.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

I agree. They told you wrong. You can get your name changed with the EAD card. It's not really that big of a deal. When you get the EAD and you file for the name change they will print something out that shows you have filed and are waiting for the card. Don't let them take the old card. They will try but don't let them. Just tell them it is at home.

Otherwise, you will need to wait until you have your EAD card and even then it will depend on if your marriage certificate has your date of birth or age or your EAD card has your married name.

4. Correcting Numident Data When a Replacement Card Cannot Be Issued

If the alien does not provide evidence of work authorization or a valid nonwork reason, explain that no replacement card can be issued.

Although a replacement card cannot be issued, the Numident can be corrected if the alien has provided documentation supporting the change (e.g., a name change).

If the alien provides documentation supporting the change, process the SS-5 to update the Numident information but suppress the issuance of a card.

The applicant may submit either:

One legal name change document showing both the old and new names (e.g., a court order for a name change or a marriage document. The document must also show either (1) a description or photograph of the person or (2) biographical information that can be compared with the Numident data; or

When the name change document does not show either a photograph of the person or biographical information that can be compared with the Numident data, then, in addition to the name change document, the applicant must also submit two identity documents listed in RM 00203.200E. One of the submitted identity documents must show the old name (the name on the latest Numident record) AND the other submitted identity document must show the new name (the name to be shown on the corrected SSN card). The identity documents submitted must show either a photograph of the applicant or provide biographical information that can be compared with the Numident data.

a. Bride Takes Groom’s Last Name

In all 50 U.S. States (this means the 50 States, Washington, D.C., Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands, and American Samoa) the bride may take her husband's last name (surname or family name) as her new last name. (EXAMPLE: Jane Doe married John Jones and she may change her name to Jane Jones.)

Interim Guidance: If the bride wants to take her husband’s last name, accept the marriage document as a legal name change for the bride if the new name can be derived from the marriage document; even if the marriage document only shows each partner’s first names, the bride’s prior surname and husband’s surname. The marriage document alone can be accepted as evidence of identity for both the old and new names when it meets the criteria described in RM 00203.200G.2.

2. Determine if the ID Document Has Required Information

Ask the applicant to submit one or more documents that show the person’s name AND provide:

Biographical information in addition to the person’s name that the reviewer can compare with the data on the SS-5 (e.g., date of birth, age, or parents' names) and/or

Physical information that the reviewer can compare with the applicant (e.g., physical description, photograph).

NOTE: A non-picture identity document must have the person's name as well as information that can be compared to the Numident, the applicant or other documents submitted (e.g., age, date of birth, or parents' names).

C. Procedure - Immigration Document as Evidence of Legal Name

When issuing immigration documents, the Department of State and DHS issue them in the person’s legal name. The legal name is also generally the name in which the foreign passport was issued.

In cases where an alien applies for a replacement SSN card and submits an immigration document showing a name that is different from the name on the prior Numident record, accept the immigration document as evidence of the legal name. In these cases, the prior SSN card may have been issued in a name that was not the NH’s legal name.

Remember that immigration status must always be verified before an SSN card can be issued.

Claudeth was told the same thing. The EAD was acceptable so when she received it she was able to get the SSN card changed. :D

That's all I wanted to do :) to change my name to the married name, but they said they can't issue me a new SS card cuz my I-94 expires on that day, I did bring my marriage certificate with me too, and it has my age.

Anyway I really wanted to change my name to married name cuz I was only born with one name, it's not unusual in Indo, lots of people has only one name. But I have problem here cuz I only have one name, they put FNU as my first name in the visa and my old SS Card, also bank account (which I think it stands for First Name Unknown) and in marriage license and certificate, my last name is 'Legally Omitted' :lol: Guess I'm stuck as a FNU for a few more months

That's a good question... I believe you would be out of status until your green card is approved... or maybe the NOA1 changes that as you have proof you have filed for something in the US?

Your status changes to "Adjustment Applicant" once you receive NOA1 for your AOS.

This really looks like the loophole that we needed. I want to personally thank MDYOUNG.

Florida changed the rules for a DL so that you can now get one with the NOA1 form AOS. We went to get the DL with this new info and the whole process came to a halt when the SS computer did not confirm the name. If I am reading this right then Lucero can have her name changed on the SS computer and we can get the DL. The actual card is pretty seriously over rated. What is more important is the number and the name.

Now I just have to wait for Lucero to get out of class so I can see if the marriage license has her age or date of birth.

If you can get the SSA office to cooperate that procedure allows for the SSN record to be correct, but a card will not be issued. Just remember if you are doing the changed based on a marriage certificate, it must have either the age or DOB. If not you are screwed, because then you would also need a document with the married name and the maiden name in addition to the marriage certificate. Once the SSN record is corrected you shouldn't have any problem with DMV in getting the DL with the married name. If you have a problem at the SSA office start yelling for the office manager.

DO NOT let them take your SSN card.
