Hi, 
Can anyone give me an advice? Last June I applied for a US tourist visa. I honestly stated that I am going to visit my boyfriend so we can meet in person, I am unemployed, and just recently graduated few months from that time, but then I got denied. I reapplied and went for an interview July 20th so obviously no changes happened within the short time and i still honestly stated everything I said on the first interview, but still I got denied. August 23, my boyfriend visited me instead and we got engaged while he was here. It was the first time we met in 1 year and 6 months of relationship. Then, this October he filed a Fiance petition for me and we are just waiting for it. However, I am planning to visit him for holidays and for his birthday so it means i would need to reapply for a tourist visa again. Is there a high possibility that i'll get denied again even if we are obviously doing things legally?

You'll get denied again if your circumstances haven't changed. You need to have a good job and ties back home. If you've been denied twice you'll probably get denied again unless something huge changed.

Also, now you're considered an intending immigrant since you have a k1 petition in.

would the 2 B2 denials affect my k1 petition?

No, it shouldn't have any impact on it. As long as you've been together a bit. Now obviously if you had applied twice then magically was in a relationship that could be a red flag. However, you said you've been together a year and six months, so that's usually plenty of time. (depending on the country)

ohh thank you, im actually from philippines so im a lil scared that it will take so many months before we get approved

You will be denied because this will be your 3rd attempt for a tourist visa in a year and when your I-129F is filed then they will assume that you want to visit him on tourist visa and probably marry and adjust status here (they have seen thousands of cases everyday) so instead they will decline your visa because on I-129F form they have all your details including passport details. I'd say ask your fiancee to come visit you again if you guys wanna spend more time.

yeah i was thinking that i will make a point by saying that ill be wasting money then if ill just marry him during my stay there under the tourist visa while waiting for the k1. I mean if im not coming back then the petition wont make any sense but a total waste of money.

Yea...you will need to start saving money now as your I-129F is already with the USCIS and once its approved you will have a lot of expenses.

Can I know how long you waited before getting the approval? because we filed october 5th, they sent an acceptance confirmation oct. 10 then after that i kept coming back to check the status and it's still the same. would i be ever notified that theyre currently reviewing it of whatnot

I got my I-129F approved in 82 days from NOA1. That also includes a RFE

I don't think it has anything to do with the country. It all depends upon which service centre is handling your petition and the amount of backlogs they have.

mine is sent to California service center. you think we'll take longer there?
