I haven't contacted to my ex wife ? Are you even intended to find your minor child? Or it was not in court order ? It sounds extremely lack of responsibility. 

When you have child, even if the court not ordered, this is still your responsibility to support them. I believe.

The answer is simple & the truth: "after the divorce, my wife cut off all contact, and I have lost contact with them since". If there is no court order for child support, then they can't hold that on him. By the way, if you read it closely, you will see that the child is not his. He is not the biological father of the child. 

 

You are applying your own moral standard to the case, while the USCIS use a different standard. The USCIS use a combination of employment, tax paid, education, pass arrest ... to make the good moral judgement. I'm pretty sure they will easily over look this, as he has been paying his court ordered child support to his american ex wife.

Where are you seeing this in the OP's statements?  I read the thread back through and didn't see anywhere where the OP has alluded to the child not being his biologically...

I do agree that the OP's proof of paying the USC child support will help show he isn't purposefully trying to avoid paying child support to his other off-spring.

Normally when people skip out on child support, it's for all of their children.

 

Hopefully the OP has some proof or evidence to show that he was previously financially supporting the overseas child for several years before the mother cut off contact.

I have seen you usually made false statements on questions. This is why I am avoiding to quote you. For example, you say if the person got his Decision can't be made and "You bet he will get another interview"

I never seen anyone who got a second interview because of that. You posted the same answers for people who asked for this question.

Coming back to your quote, this is common sense you will cut off with your ex gf or ex wife but the child is his, this is his reponsibility. If you said because you cut off the contact with your ex wife and you didn't need to take care of your child was that easy, then US won't take it so seriously on Child Support Obligations. By saying that, to me, you are not deserved to be the child father. 

Period.

Except this isn't the entire truth.

The OP already stated that he was in contact with his ex-wife for several years after the divorce, paying child support then.

He also never said that the wife purposefully/maliciously cut off all contact, only that he "lost contact" with her and the child later on.

It sounds like the mother is equally at fault here. She is denying the child a relationship with his/her father because she's angry with the father. As Judge Judy always says (and how I love that woman!) "you should love the child more than you hate the other parent". It's not just about money. Maybe she doesn't need any money from him. She could be a millionaire, fir all we know. But the child needs a father. Her behavior is nothing short of selfish and immature.

 

OP, have you tried to make contact through the child's grandparents? Their daughter sounds irresponsible but maybe the grandparents are more sensible about this and can help you make contact? If not for money, at least for the child to know his/her father.

My friends was rejected because of the same.  His first wife he divorced and she did not want child support so he paid none.  His second child he pays child support for.  They said he did not qualify for citizenship for gmc due to no proof of support to first child regardless of no child support order.

Did he get a notarized letter or sworn statement from his first wife stating she did not want child support?  Did he offer and she still turn him down and have factual proof of that?

You haven't seen it doesn't mean it didn't happen. I'm not an immigrant lawyer, and neither are you. We answer based on our experience, and all each of us know is a our own case, or the cases you heard from family and friend. My wife got a "decision can't be made", and she got a 2nd interview. From my view, USCIS got a lot stricter after the new president, and it is not the same as a few years ago. I post it to warn other people to prepare. How will that case turn out? Let's wait and see if he will report back the result before you call me a lier.

"The issue is that I have a child back in my home country that I have not paid child support to in several years. There is no court ordered support, and I have no idea how to even contact my ex (she left me for someone else so literally changed phone numbers etc overnight)."  ... This is what the guy said. The wife cut him off, not the other way around. How do you support the child if the wife cut you off? Track down her new family, stalking them & insist on inserting yourself into her new relationship? Sue her and demand to have the child 1/2 of the time? Would that help or hurt the child?

 

The purpose here is to help him with the immigration issue, not teaching him a moral lesson or tell him how to live his life. This case is really up to the immigration officer. Some might not even ask. So neither you or I can tell him if he will get his citizenship or not.
